THE CHHATTISGARH SINCHAI PRABANDHAN ME
KRISHKON KI BHAGIDARI VIDHEYAK, 2006.
A Bill to provide for Farmers Participation in the Management of Irrigation System and for matters connected therewith or Incidental thereto.
Be it enacted by the State Legislature in the Fifty­ Seventh Year of the Republic of India, as follows: –
CHAPTER ­I – PRELIMINARY
Short title, extent and commencement 1. (1) This Act may be called the Chhattisgarh Sinchai Prabandhan Me Krishkon Ki Bhagidari Adhiniyam, 2006.  
    (2) It extends to the whole of the State of Chhattisgarh.  
    (3) It shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint and different dates may be appointed for different areas and for different provisions.  
Definitions 2. (1) In this Act, unless the context otherwise requires: –  
      (a) "agreement” means an agreement between the Water Users’ Association and the Project Committee or Canal Officer as the case may be, for all aspects of irrigation management including rehabilitation of the distributory system, supply of water on volumetric basis for irrigation and handing over of physical system for operation, maintenance, management and related purposes;  
      (b)  “area of operation” in relation to farmers’ organisation means a contiguous block of land in the command area of an irrigation system as may be notified by the State Government for the purposes of this Act;  
      (c)  “ayacut road” means a road within the area of operation of a farmers’ organisation for the purpose of irrigation and agriculture but does not include a road vested in a Gram Panchayat, Janpad Panchayat, Zila Panchayat, Nagar Panchayat, Municipal Council, Municipal Corporation or Public Works Department of the State Government.  
      (d)  “canal officer” means the following Officers of the Water Resources Department namely: ­­  
        (i) Chief Engineer;  
        (ii) Superintending Engineer;  
        (iii) Executive Engineer;  
        (iv) Sub-­Divisional Officer;  
        (v) Canal Deputy Collector and  
        (vi) Sub­-Engineer  
      (e)  “command area” means an area irrigated or capable of being irrigated either by gravitational flow or by lift irrigation or by any other method from a Government or the Government aided source and includes every such area whether it is called ‘ayacut’ or by any other name under any law for the time being in force;  
      (f)  “competent authority” means the competent authority appointed under Section 29;  
      (g) “distributory system” means and includes,  
        (i) all main canals, branch canals, distributories and minor canals constructed for the supply and distribution of water for irrigation.  
        (ii) all works, structures and appliances cnected with the distribution of water for irrigation; and  
        (iii) all field channels and other related channels and structures under a pipe outlet;  
      (h)         “drainage system” means and includes, –  
        (i)       channels either natural or artificial, for the discharge of waste or surplus water and all works connected therewith or ancillary thereto;  
        (ii)  escape channels from an irrigation or distribution and other works connected therewith, but does not include works for removal of sewage;  
        (iii)      all collecting drains and main drains to drain off surplus water from field drains; and  
        (iv) all field drains and related structures under pipe outlets;  
      (i)  “farmers’ organisation” wherever it   occurs, shall mean and include, –  
        (i) water users’ association at the primary level consisting of all the water users as constituted under section 4;  
        (ii) distributory committee at the secondary level as constituted under section 7; and  
        (iii) project committee at the project level, as constituted under section 10;  
      (j) “farmers participation in management of irrigation system” means involvement of water users in all aspects of irrigation in the irrigation system including planning, designing, operation, maintenance, rehabilitation, modernization, administering rights, resolving of conflicts, determination and collection of Irrigation Water Rate, monitoring, evaluation, budgeting, and financial management, and extends to providing and coordinating irrigation and agriculture related services  
      (k)         “field channel” includes a channel existing or to be constructed by the State Government or by the land holders or by an agency to receive and distribute water from a pipe outlet or an opening in a water course for irrigation of field belonging to Government or private owners, –  
      (l)          “field drain” includes a channel excavated and maintained by the land holder or by any other agency, to discharge waste or surplus water from the land holding under a pipe outlet and includes drains, escape channels and other similar works existing or to be constructed;  
      (m)                “financing agency” means any commercial bank or any co­operative society or any other bank or organisation established or incorporated under any law for the time being in force, which lends money for the development of the area of operation of the farmers’ organisation;  
      (n)                  “general body” in relation to Water Users’ Association means the body of all members of such Association;  
      (o)         “hydraulic basis” means the basis for identifying a viable irrigated area served by one or more hydraulic structures such as headworks, distributories, minors, pipe outlets and the like;  
      (p)         “irrigation system” means such major, medium and minor irrigation system excluding those which are under the control of Panchayat for harnessing water for irrigation and other allied uses from Government sources and also sources created by means of community participation, which is duly permitted by the District Collector and includes reservoirs, open head channels, diversion systems, anicuts, stop dams, lift irrigation schemes, bore/tube wells, tanks, wells and the like and such irrigation system irrigating an area greater than 40 hectares;
Explanation:
 
        ­­(i)  ‘major irrigation system’ means irrigation system under major irrigation project having irrigable command area of more than 10,000 hectares;  
        (ii)         ‘medium irrigation system’ means irrigation system under medium irrigation project having irrigable command area of more than 2,000 hectares and up to 10,000 hectares;  
        (iii)    ‘minor irrigation system’ means irrigation system under minor irrigation project having irrigable command area of more than 40 hectares and up to 2,000 hectares;  
      (q)        “land holder” means an owner and or a tenant recorded as such in the record of rights under the Chhattisgarh Land Revenue Code, 1959 (No. 20 of 1959) in respect of land in the notified ayacut area of an irrigation system;  
      (r)         “lift irrigation” or “lift irrigation scheme” in relation to lift irrigation Water Users’ Association means all lift irrigation Schemes, wherein Government permission is required for lifting water, but excluding the lift irrigation schemes on private open wells and bore wells;  
      (s)         “lift and tube well irrigation water users’ association” in relation to management of irrigation system by farmers, means an association constituted for the purpose of lift and tube well irrigation , constituted in the prescribed manner as provided under Sections 21 and 22 of the Act;  
      (t)        “maintenance” means execution of such works on the irrigation system as are necessary to ensure that the physical system designed to the standards operates for proper distribution of water to the land holders in the area of operation;  
      (u)        “managing committee” means the managing committee of any farmers’ organisation;  
      (v)         “member” means the member of any farmers’ organisation.  
      (w)       “operational plan” means a schedule of irrigation deliveries with details of the mode and duration of supplies drawn up for regulation of irrigation in the command area of an irrigation system;  
      (x)       “prescribed” means prescribed by Rules made under the Act;  
      (y)        “territorial constituency” for the purposes of this Act means an area delineated on hydraulic basis and to the extent possible represents an area irrigated by one common canal;  
      (z)        “warabandi” means a system of distribution of water allocation to water users by turn, according to an approved schedule indicating the day, duration and the time of supply;  
      (za)     “water allocation” in relation to an irrigation system means distribution of water determined from time to time by a farmer’s organisation in its area of operation;
Provided that the allocation at the Project area level would be determined jointly by the farmers organisations and the Canal Officer, as the case may be;
 
      (zb)     “water user” means and includes any individual or body corporate or a society using water for agriculture, domestic, power, non­domestic, commercial, industrial or any other purpose from a Government source of irrigation;  
    (2)      The words and expressions used in this Act, but not defined, shall have the same meaning as assigned to them in the Chhattisgarh Irrigation Act, 1931 (No. 3 of 1931).  

CHAPTER ­II – CONSTITUTION OF FARMERS’ ORGANISATION

AND DELINEATION OF COMMAND AREA THEREOF
  3. (1) The District Collector, may by notification and in accordance with the rules made under this Act, in this behalf, delineate every command area in consultation with the farmers who are proposed beneficiaries under each of the irrigation systems and on a hydraulic basis which may be administratively viable; and declare it to be a water users’ area for the purpose of this Act: Provided that any water users’ area in minor, medium & major irrigation system shall not exceed 2000 hectares; Provided that in respect of the command area under the minor and lift irrigation systems, the entire command area may, as far as possible form a single water users’ area; Provided further that for minor irrigation system including irrigation systems comprising more than one
minor scheme a Water Users’ Association may be formed with an area of two hundred hectares and above, and to the extent possible; Provided further that there may be one Water User Association for more than one Minor Scheme when the aggregate command area of such schemes is less than 200ha and are located next to each other or are at reasonable distance from one another;
Delineation of water users’ area
    (2) The modifications of delineated Water Users Association Area in sub­section (1) shall be notified by the District Collector and would be based on recommendations made by the Canal Officer in Charge of irrigation project and such canal officer shall arrive at the recommendation made in this regard only after consultation with the farmers who are proposed beneficiaries under such Schemes;  
    (3) Every Water Users Associations' Area shall be divided into territorial constituencies which shall be up to ten in minor irrigation systems and twelve in major and medium irrigation systems:
Provided that there is no necessity of formation of ten territorial constituencies for constituting a Water Users’ Association in cases of commanded area of less than two hundred hectares and no necessity of formation of any territorial constituency in case of Lift Irrigation Water Users’ Association.
 
Constitution of Water Users’ Association 4. (1)     There shall be a Water Users’ Association called by its local distinct name for every Water Users’ Association’s area delineated under Section 3.  
    (2)      Every Water Users’ Association shall consist of the following members, namely:­  
      (a) all the water users who are land holders in a water users’ area:
Provided that where both the owner and the tenant are landholders in respect of the same land, the tenant would be the deemed water user;
Provided further that any person who is in lawful possession and enjoyment of the land under a water source, on proof of such possession and such enjoyment in a crop year, may claim membership not withstanding whether he is recorded land holder or not, in which case the Water Users’ Association shall not refuse the membership of such person for the purposes of this Act, and such person shall be liable to pay the water charges and the fees as may be prescribed as if he is the water user;
Provided further that the wife / wives of such land holder, who do not hold land, shall deemed to be the landholders for the purpose of this act.
 
      (b)      all other water users in a water users’ area;  
      (c)    Government may, by notification, nominate one officer each from the Water Resources Department and the Department of Agriculture or Ayacut Department to be the members of the Water Users' Association as advisors and without having the right to vote.  
    (3) The members specified in sub­section (2) shall constitute the general body of the Water Users’ Association.  
  5. (1)    There shall be a Managing Committee for every Water User Association. Constitution of Managing Committee of Water Users Association and election of its President and Members
    (2)      The Managing Committee for each Water Users Association would comprise of the elected representatives of the Territorial Constituencies as specified in sub­section (3) of Section 3.
    (3)       The term of the office of the members of the territorial constituencies shall, if not recalled or removed or disqualified under the provisions of the Act, shall be five years from the date of first meeting of the Managing Committee : Provided that the term of office can be extended up to one year by the State Government, under special circumstances.  
    (4)     The first meeting of Management Committee shall be held within 30 days after the declaration of election results.  
    (5)       The District Collector shall make arrangements for the election of President of the Managing Committee of the Water Users’ Association by direct election by the method of secret ballot in the manner prescribed.  
    (6)      The District Collector shall cause arrangement for the election of a Managing Committee consisting of one member from each of the territorial constituencies of a Water Users area by a simplified election procedure in the manner prescribed:
Provided that a person eligible to become an elected representative of more than one territorial constituency of a Water Users’ Association shall be entitled to be such a representative of only one territorial constituency, at his option and he/she shall exercise such option before filing his/her nomination for the election;
Provided further that no person can be a member of a Managing Committee of more than one Water Users’ Association.
 
    (7)      If at an election, the President or the members of the territorial constituencies of Water Users’ Association are not elected fresh election shall be held within a period of 90 days from the date of failure in the same manner as specified in sub­section (5) or (6), as the case may be.   
    (8)    The State Government may nominate an officer at an appropriate level from the Water Resources Department without having the right to vote, to be the Secretary of the managing committee of the Water Users’ Association.  
    (9)       The Managing Committee shall elect one Treasurer from among the members of the Managing Committee to assist the President and the Treasurer shall function as directed by the Managing Committee.  
    (10)      For the purposes of equitable distribution of water, adequate representation shall be given in the Managing Committee, to the water users from the Head, Middle and Tail reaches of the area of operation of the Water Users’ Association as may be prescribed;  
    (11)     Seats shall be reserved in every Management Committee of Water Users’ Association for the Scheduled Castes, Scheduled Tribes and other Backward Classes and the number of seats so reserved shall bear as nearly as may be the same proportion to the total number of seats to be filed by direct election in that Water Users’ Association as the number of Scheduled Castes, Scheduled Tribes and other Backward Classes of the water users in that water users area bears to the total number of water users of that area and such seats shall be allotted by the prescribed authority to different Territorial Constituency in that Water Users Association, in the prescribed manner.
Provided that such reservation of seats shall not exceed fifty percent of the total members of the Managing Committee of the Water Users’ Association.
 
    (12) The Territorial Constituency which have no population of Scheduled Castes, Schedules Tribes or other Backward Classes of water users shall be excluded for allotment of seats reserved for Scheduled Castes or Scheduled Tribes or other Backward Classes as the case may be.  
    (13) One third of total number of seats reserved under subsection (11) and unreserved seats shall be reserved for women candidates and the reservation shall be horizontal and compartment-­wise.  
      Explanation: "Horizontal and compartment­-wise reservation" means reservations in each category namely; Scheduled Castes, Scheduled Tribes, other Backward Classes and General.  
    (14)   Seats reserved for women may be allotted by the prescribed authority by drawing of lots and by rotation to different Territorial Constituency in a Water Users’ Association in the prescribed manner.  
    (15)    There shall be nomination of one member from the Gram Panchayat, from among the Gram Panchayat(s) within the water users’ area, to the Managing Committee and such member shall not have the right to vote.  
      Provided that such nomination would be decided by the Managing Committee in concurrence with the Gram Panchayat(s) in the water users’ area and in the prescribed manner.  
    (16)     The President of the Managing Committee of water users association shall, if not recalled or removed or disqualified by the provisions of the Act, be in office for a period of five years from the date of election or his tenure as member of territorial constituency, whichever is earlier.  
    (17)          The Managing Committee shall exercise the powers and Association. perform the functions of the Water Users’  
Delineation of Distributory area 6. (1)     The State Government may, by notification and in accordance with the rules made in this behalf, delineate every command area of the irrigation system, comprising of three or more water users’ association, and declare it to be a distributory area for the purpose of this Act:
Provided that for medium and major schemes, a Distributory Committee may be formed only when its water distribution network so warrants
 
    (2)     The delineation in (1) shall be based on recommendations made jointly by the Canal Officer in charge of the concerned irrigation projects and the concerned Water User Associations.  
Constitution of the Distributory Committee 7. (1)     There shall be a Distributory Committee called by its local distinct name for every distributory area declared as such under sub­section (1) of Section 6.  
    (2) (a) All the Presidents and Management Committee members of the water users associations in the distributory area, so long as they hold such office, shall constitute the general body of the committee.  
      (b)      Government may, by notification, nominate one officer each from the Water Resources Department and the Department of Agriculture or Ayacut Department to be the members of the Distributory Committee as advisors and without having the right to vote.  
Constitution of Managing Committee of Distributory Committee and election of its President and Members 8. (1)    There shall be a Managing Committee for every Distributory Committee.  
  (2) The State Government shall cause arrangements, in such manner as may be prescribed, for the election by the method of secret ballot of the President and Members of the Managing Committee who shall be five or more in number but not more than fifteen and depending on the commanded area covered by that distributory command and from amongst the members of the general body of the Distributory Committee:  
      Provided that if at an election, the President or the members of the Managing Committee for a Distributory  
    (3)     The State Government may nominate an officer at an appropriate level from the Water Resources Department without having the right to vote, to be the Secretary of the managing committee of the Distributory Committee.  
    (4)  The Managing Committee shall elect one Treasurer from among the members of the Managing Committee to assist the President and the Treasurer shall function at the direction of the Managing Committee.  
    (5)    For the purposes of equitable distribution of water, adequate representation shall be given in the Managing Committee from the Head, Middle and Tail reaches of the area of operation of the Distributory Committe in such manner as may be prescribed.  
    (6)    Seats shall be reserved in every Managing Committee of Distributory Committee for the Scheduled Castes, Scheduled Tribes and other Backward Classes and the number of seats so reserved shall bear as nearly as may be the same proportion to the total number of seats to be filed in that Managing Committee as the number of Scheduled Castes, Scheduled Tribes and other Backward Classes of the water users in that distributory area bears to the total number of water users of that area and such seats shall be reserved by the prescribed authority and in the prescribed manner.  
      Provided that such reservation of seats shall not exceed fifty percent of the total members of the Managing Committee of the Distributory Committee.  
    (7)    One third of total number of seats reserved under subsection (6) and unreserved seats shall be reserved for women candidates and the reservation shall be horizontal and compartment-­wise. Explanation: "Horizontal and compartment-­wise reservation" means reservations in each category namely; Scheduled Castes, Scheduled Tribes, other Backward Classes and General.  
    (8)       Seats reserved for women may be reserved in the prescribed manner.  
    (9)      There shall be nomination of one member from the Janapad Panchayat, from among the Janapad Panchayat(s) within the Distributory area, to the Managing Committee and such member shall not have the right to vote.  
      Provided that such nomination would be decided by the Managing Committee in concurrence with the Janapad Panchayat(s) in the Distributory area and in the prescribed manner.  
    (10)   The term of office of the President and the members of the Managing Committee shall be five years from the date of the first meeting of the Managing Committee, unless recalled earlier under section 14 of the Act.  
      Provided that the term of office can be extended up to one year by the State Government, under special circumstances.  
    (11) The first meeting of Management Committee shall be held within 30 days after the declaration of elections results.  
    (12) The Managing Committee shall exercise the powers and perform the functions of the Distributory Committee.   

 

Delineation of Project area 9. (1) The State Government, may by notification and in accordance with the rules made under this Act in this behalf, delineate every command area or part thereof, and declare it to be a project area for the purposes of this Act.  
    (2)    The delineation in sub­section (1) shall be based on recommendations made jointly by the Canal Officer in Charge of the concerned irrigation projects and the Presidents of the Distributory Committees in the project area.  
Constitution of Project Committee 10. (1) There shall be a Project Committee called by its distinct name for every project area declared as such under sub­section (1) of Section 9 above.  
    (2)    In Irrigation systems, where there are distributory committees all the Presidents and member of managing committee of the Distributory Committees in the Project Area, so long as they hold such office, shall constitute the general body of the Project Committee.  
    (3)   In Irrigation systems, where there are no distributory committees all the Presidents and member of managing committee of the Water Users Associations in the project area, so long as they hold such office, shall constitute the general body of the Project Committee.  
    (4)     Government may, by notification, nominate one officer each from the Water Resources Department and the Department of Agriculture or Ayacut Department to be the members of the Project Committee as advisors and without having the right to vote.  
  11. (1) There shall be a Managing Committee for every Project Committee. Constitution of Managing Committee of Project Committee and election of its President and Members
    (2)       State Government shall cause arrangements, in such manner as may be prescribed, for the election by the method of secret ballot of the members of the Managing Committee who shall not be more than nine from amongst the members of the general body of the Project Committee. 
    (3)     The State Government may nominate an officer at an appropriate level from the Water Resources Department without having the right to vote, to be the Secretary of the managing committee of the Project Committee.  
    (4) The Managing Committee shall elect one Treasurer from among the members of the Managing Committee to assist the President and the Treasurer shall function at the direction of the Managing Committee.  
    (5) For the purposes of equitable distribution of water, adequate representation shall be given in the Managing Committee of the Project Committee from the Head, Middle and Tail reaches of the area of operation of the Project Committee in such manner as may be prescribed.  
    (6) Seats shall be reserved in every Managing Committee of the Project Committee for the Scheduled Castes, Scheduled Tribes and other Backward Classes and the number of seats so reserved shall bear as nearly as may be the same proportion to the total number of seats to be filed in that Managing Committee as the number of Constitution of Managing Committee of Project Committee and election of its President and Members Scheduled Castes, Scheduled Tribes and other Backward Classes of the water usersin that Project area bears to the total number of water users of that area and such seats shall be reserved by the prescribed authority and in the prescribed manner.
Provided that such reservation of seats shall not exceed fifty percent of the total members of the Managing Committee of the Project Committee.
 
    (7) One third of total number of seats reserved under subsection (6) and unreserved seats shall be reserved for women candidates and the reservation shall be horizontal and compartment­wise. Explanation: "Horizontal and compartment­wise reservation" means reservations in each category namely; Scheduled Castes, Scheduled Tribes, other Backward Classes and General.  
    (8) Seats reserved for women may be reserved in the prescribed manner.  
    (9) There shall be nomination of one member from the Zila Panchayat, from among the Zila Panchayat(s) within the Project area, to the Managing Committee and such member shall not have the right to vote. Provided that such nomination would be decided by the Managing Committee in concurrence with the Zila Panchayat(s) in the Project area and in the prescribed manner.  
    (10) The term of office of the President and the members of the Managing Committee shall be five years from the date of first meeting of Managing Committee. Provided that the term of office can be extended up to one year by the State Government, under special circumstances.  
    (11) The first meeting of management committee shall be held within 30 days after the declaration of election results.  
    (12) The term of office of the President and the members of the Managing Committee of Project Committee shall if not recalled or removed or disqualified under the provisions of the Act earlier, be coterminous with their respective terms as specified.  
    (4) The Committee, constituted under sub­section (1) shall exercise such powers and functions as may be necessary to lay down the policies for implementation of the provisions of this Act  
    (13) The Managing Committee shall exercise the powers and perform the functions of Project Committee.  
  12 The farmers’ organisation under the Act may decide to federate and form a state level farmers federation to facilitate interactions of the state government and non government organizations with the farmers, to support farmers participation in management of irrigation systems and further to coordinate and deal with allied activities relating to irrigated agriculture.   13 (1) The State Government may by Notification, constitute a Policy Committee consisting of the following Members, namely: – State Level Policy Committee
      (a) The Minister in charge of Water Resources Department – Chairperson;  
      (b) three persons from amongst the Presidents of the Project Committee;  
      (c) two persons from amongst the Presidents of Water User Associations from the minor irrigation systems;  
      (d) two persons from non­government organisations including one person having knowledge in the field of participatory irrigation management ; and  
      (e) three officers not below the rank of Chief Engineer or equivalent including one each from the Water Resources Department, Agriculture Department and Ayacut Department of the State Government.  
    (2) The number of members may be increased by such number as may be considered necessary by the State Government.  
    (3) The committee constituted under sub­section (1) shall mandatorily have at least one third women members from amongst the Presidents of the Project Committee and the Presidents of the Water Users' Associations and to the extent possible representatives of Government department and Non-­Government Organizations (NGOs) shall also have at least one third women.  
    (4) The Committee, constituted under sub-section (1)
shall exercise such powers and functions as may be necessary to lay down the policies for implementation of the provisions of this Act
 
Procedure for recall   14. (1) A motion for recall of a President or member of a Managing Committee, as the case may be, of a farmers’ organisation may be made by giving a written notice as may be prescribed, signed by not less than one third of the total number of members of the farmers’ organisation, who are entitled to vote. Provided that no notice of motion under this section shall be made within one year of the date of assumption of office by the person against whom the motion is sought to be moved.  
    (2) If the motion is carried with the support of the two thirds majority of the members present and voting and half of the total number of members of the association, voting at a meeting of the general body specially convened for purpose, the District collector or the state Government, as the case may be, shall by order remove him from office and the vacancy shall be filled in the manner specified in Section 20.

15. The President of a farmers’ organisation may be removed Removal of the by the members of the Managing Committee of the same President by the farmers’ organisation through a resolution passed by two­ Managing third members of such managing committee.  
Constitution of Sub-committees in farmers’ organisation 16. (1)  The Managing Committee of a farmers’ committees in organization may constitute sub­committee to carryout all farmers’ or any of the functions vested in each organization under organisation the Act.  
    (2) The sub­committees constituted under sub­section  
    (3) shall have a minimum of one ­third women members from the concerned farmers’ organisation.  
Farmers’ organisation to be a body corporate 17. Every farmers’ organisation shall be a body corporate with organisation to be a distinct name having perpetual succession and a common body corporate seal and subject to the provisions of this Act vested with the capacity of entering into contracts and of doing all things necessary, proper or expedient for the purposes for which it is constituted and it shall sue and be sued in its corporate name represented by the President, as the case may be: Provided that no farmers’ organisation shall have the power to alienate in any manner, any property vested in it.  
  18. The State Government may, in the interest of a Farmers’ Organisation in the command area and with prior consent of the concerned farmers’ organisation, by notification, and in accordance with the rules made in this behalf, – Changes in Farmers’ organisation
      (a) form a new farmers’ organisation by separating the area from any farmers’ organisation;  
      (b) increase the area of any farmers’ organisation;  
      (c) diminish the area of any farmers’ organisation;  
      (d) alter the boundaries of any farmers’ organisation; or  
      (e) cancel a notification issued under this Act for rectifying of any mistake. Provided that no such separation, increase, diminution, alteration or cancellation shall be effected unless a reasonable opportunity of being heard is given to the organisation likely to be affected.  
  19. (1) No officer or servant of the Government of India or any State Government or of a local authority or an employee of any institution receiving aid from the funds of the State Government shall be qualified for being chosen as or for being a President or a member of a Managing Committee. Disqualificat-ions of

    (2) No person who has been convicted by a criminal court for any offences involving moral turpitude shall be qualified for being chosen as or for being a President, or a member of a Managing Committee.  
    (3) A person shall be disqualified for being chosen as a President or a member of a Managing Committee if on the date fixed for scrutiny of nominations for election he is: –  
      (a) of unsound mind  
      (b) an applicant to be adjudicated as an insolvent or an undischarged insolvent; or  
      (c) a defaulter of land revenue or water tax or charges payable either to the State Government or to the farmers’ organisation: Provided that the defaulter as above, on payment of arrears for the previous three years would not be disqualified and such limit of the previous three years would apply only for the purposes of the first election after the enactment of this Act;  
      (d) interested in a subsisting contract made with, or any work being done for, the Gram Panchayat, Janpad Panchayat, Zila Panchayat, or any State Government or Central Government or the farmers’ organisation:
Provided that a person shall not be deemed to have any interest in such contract or work by reason only of his having share or interest in: –
 
        (i) a company as a mere share­holder but not as a director;  
        (ii) any lease, sale or purchase of immovable property or any agreement for the same; or  
        (iii) any agreement for the loan of money or any security for the payment of money only; or  
        (iv) any newspaper in which any advertisement relating to the affairs of the farmers’ organisation is inserted;
Explanation – for the removal of doubts it is hereby declared that where a contract is fully performed it shall not be deemed to be subsisting merely on the ground that the Gram Panchayat, Janpad Panchayat, Zila Panchayat, the Farmers’ organisation, the State Government or Central Government has not performed its part of the contractual obligations. 
 
      (e) a person rendered landless or having lost the possession of the land or ceasing to be a water user due to sale or transfer operation after constitution Association; of land in of Water area of Users’  
      (f) employed in Government or semi-Government organisation or local body; or Semi  
    (4) A President or a member of a Managing Committee shall also become disqualified to continue in office if he–  
      (a) absents from three without reasonable cause; consecutive meetings  
      (b) is a person who incurs any of the disqualifications mentioned in sub­section (1), (2) and (3) and he shall cease to hold the office forthwith; Provided that disqualification under clause (a) shall not apply in the case of women who are in advanced stage of pregnancy and for a period of three months after delivery.  
    (5) A member of the Water Users’ Association or a President or a member of a Managing Committee shall become disqualified to continue the office, if he/she ceases to be a Water User.  
  20. (1) A vacancy arising either due to disqualification under sections 14 and 19 or due to death or resignation or by any reason, such vacancy shall be filled up by nomination in the following manner, namely: Filling up of Vacancies
      (a) In case of the vacancy of the Water Users Association President, the Managing Committee of the Water Users Association will select an acting President from its members. Failing to be able to make this decision, the Collector shall appoint one member of the Managing Committee as the Acting President. In the case of the vacancy of a member of the Managing Committee, or when a member of the Managing Committee has been nominated as President, the Collector shall arrange an election in the respective Territorial Constituency in the prescribed manner;  
      (b) In case of the vacancy of the President of the Distributory Committee, the Managing Committee of the Distributory Committee will select an acting President from amongst themselves. Failing to be able to make this decision the vacancy shall be filled by nomination by the managing committee of the Project Committee in the manner prescribed. In the case of the vacancy of a member of the Managing Committee of the distributory committee, or when a member of the Managing Committee has been nominated as President, the concerned Chief Engineer shall appoint a representative from the respective Water Users Associations;  
      (c) In case of a vacancy of the President of the project committee the Managing Committee of the Project Committee will select an acting President from amongst themselves. Failing to be able to make this decision, the concerned Chief Engineer will appoint one member of the Project Committee as the Acting President. In the case of the vacancy of a member of the Managing Committee of the Project Committee, or when a member of the Project Committee has been nominated as President, the concerned Chief Engineer shall appoint a representative from the respective Distributory Committee.  
    (2) Where the District Collector is required to arrange for an election for filling up of vacancies in sub section (1), the Collector shall take necessary steps to conduct elections to fill up any vacancy caused within a period of two months from the date of occurrence of such vacancy. However, if it is within three months of the ordinary election, the election will be held as normally scheduled.  
    (3) The term of office of a member or President of a farmers’ organisation elected under sub­section (2) shall expire at the time at which it would have expired, if he had been elected at the ordinary election.

22. A Canal Officer not below the rank of an Executive Engineer, duly empowered by the competent authority in this behalf shall, by notification in the Official Gazette and in accordance with the Rules made under the Act, delineate command areas of Lift and Tubewell Irrigation Water Users’ Associations, separately based on prescribed guidelines and declare those area to be the areas of operation of respective Lift and Tube Well Irrigation Water Users’ Associations for the purposes of this Act.   23. In Order to avoid overlapping in command areas of flow and lift irrigation and complications arising thereby, a Canal Officer not below the rank of an Executive Engineer, duly empowered by the competent authority in this behalf with prior consent of the beneficiary farmers may give permission to form Lift Irrigation Water Users’ Association, on notified rivers or streams in the command of flow irrigation , after delineating the area of flow and lift irrigation separately in the prescribed manner. CHAPTER  ­III – OBJECTS, POWERS AND FUNCTIONS OF THE FARMERS’ ORGANISATION
           
  24. The objects of the farmers’ organisation shall be to promote and secure equitable distribution of water among its users; adequate maintenance of the irrigation system, efficient and economical utilization of water to optimize agricultural production, to protect the environment, and to ensure ecological balance by involving the farmers, inculcating a sense of ownership of the irrigation system in accordance with the water budget and the operation plan.     The farmers’ organisation may also engage into any activity of common interest of members in the command area related to irrigation and agriculture such as procurement and distribution of seeds, fertilizers and pesticides; procurement and renting of agricultural implements; marketing and processing agricultural produce from the Command Area and supplementary business like dairy and fisheries.  
  25. (1) The Water Users’ Association shall perform the following functions, namely: – Powers and

      (a) to prepare and implement a warabandi schedule for each irrigation season consistent with the operational plan based upon entitlement, area, soil and cropping pattern, as approved by the Distributory Committee, or as the case may be, the Project Committee;  
      (b) to prepare a plan for the maintenance of irrigation system in the area of its operation at the end of each crop season and carry out the maintenance works of both distributory system and minor and field drains in its area of operation with the funds of the association from time to time and to provide funds for the maintenance of staff including such persons who are placed by the State Government with the Water Users’ Association for the purpose of regulation and maintenance of irrigation system;  
      (c) to seek information regarding canal operation schedule from the upper level Committee or the concerned canal officer;  
      (d) to convene a meeting of the Managing Committee before each irrigation season to guide and help the members regarding­ -  
        (i) Canal operation schedule and water distribution programme;  
        (ii) Maintenance of canal system before commencement of season;    
        (iii) the information about the latest decisions taken by the upper level committees;    
      (e) to make recommendation to the Managing Committee for, and prior to, decisions relating to water allocation, cropping schedule, operation and maintenance of the Irrigation System;    
      (f) to collect prescribed rate of water charges from the members of the Association including arrears that may arise after the coming into force of this Act and deposit the charges so collected in the manner prescribed;    
      (g) to collect the arrears on water charges arisen before the coming into force of this Act under an appropriate incentive scheme to be devised by the state government and as prescribed under the rules;    
      (h) to carry out annual maintenance and repairs of canal system falling under its jurisdiction;    
      (i) to regulate the use of the water among various pipe outlets under its area of operation according to the warabandi schedule of the system;    
      (j) to promote economy in the use of water allocated;    
      (k) to maintain a register of land holders as published by the Revenue Department    
      (l) to prepare and maintain a register of co-­opted members;    
      (m) to prepare and maintain an inventory of the irrigation system within the area of operation;    
      (n) to monitor flow of water for irrigation;    
      (o) to undertake all allied activities related to irrigated agriculture;    
      (p) to resolve the disputes, if any, between members and water users in its area of operation;    
      (q) to raise resources;  
      (r) to maintain accounts;  
      (s) to cause annual audit of its accounts;  
      (t) to assist to conduct elections to the Managing Committee;  
      (u) to maintain other records in such manner as may be prescribed;  
      (v) to abide by decisions of the Distributory and Project Committees;  
      (w) to conduct General Body meetings in such manner as may be prescribed;  
      (x) to conduct regular water budgeting and also to conduct periodical social audit in such manner as may be prescribed.  
    (2) Power to remove encroachments:-
A Water Users’ Association may remove encroachments from property attached to the canal system within its area of operation in accordance with such procedure as may be prescribed.
 
    (3) Agreement with the Water Users’ Association:-  
      (a) There shall be an agreement between the Water Users’ Association and the upper level  
        committee or the Canal Officer within three months of the constitution of the concerned Water Users’ Association;  
      (b) Supply of water for irrigation to any water  Users’ Association within the area of management of Irrigation systems by farmers and provisions for proper maintenance and repairs of irrigation systems within the area of a farmers’ organization shall be in accordance with the agreement;  
      (c) The Agreement shall contain the contents as may be prescribed.  
Functions of
Distributory
Committees
26. The Distributory Committee shall perform the following functions, namely:  
      (a) to prepare an operational plan based on its entitlement area, soil, cropping pattern, at the beginning of each irrigation season, consistent with the operational plan prepared by the Project Committee;  
      (b) prior to each season, identify the critical maintenance works that are to be carried out ,prioritize these works, prepare a plan for the maintenance of both distributories and medium drains within area of its operation , execute the Maintenance works with the fund of the committee, monitor the maintenance works being executed and ensure that they conform to prescribed standards and to provide funds for the maintenance of staff including such persons who are placed by the State Government with the Distributory Committee for the purpose of regulation and maintenance of irrigation system.  
      (c) to regulate the use of water among the  various Water User Associations and monitor the flow of water for irrigation under its area of operation;  
      (d) to resolve disputes, if any, among the Water Users Associations in its area of operations;  
      (e) to maintain a register of Water User Associations in it area of operations;  
      (f) to maintain an inventory of the irrigation system in the area of its operation, including drains;  
      (g) to promote economy in the use of water allocated;  
      (h) to maintain accounts;  
      (i) to cause annual audit;  
      (j) to maintain other records as may be prescribed;  
      (k) to monitor flow of water for irrigation;  
      (l) to conduct General Body meetings in such manner as may be prescribed;  
      (m) to abide by decisions of the Project Committee;  
      (n) to cause regular water budgeting and also the periodical social audit in such manner as may be prescribed;  
      (o) to assist in the conduct of elections to the Managing Committee.  
      (p) to establish bye­laws establishing rules and sanctions of the organization for implementing the above functions.  
  27   (a) . The Project Committee shall perform the following functions, namely: – to prepare an operational plan based on its entitlement area, soil, cropping pattern, as prepared by the Competent Authority in respect of the entire project area at the beginning of each irrigation system; Functions of Project Committees
      (b) to approve a plan for the extension, improvements, renovation, modernization and annual maintenance of irrigation system including the major drains within area of its operation at the end of each crop season and execute the maintenance works with the fund of the committee from time to time and to provide funds for the maintenance of staff including such persons who are placed by the State Government with the Distributory Committee for the purpose of regulation and maintenance of irrigation system.  
      (c) to maintain a list of Distributory Committees and Water User Associations in its area of operation;  
      (d) to maintain an inventory of the distributory and drainage systems in it area of operations;  
      (e) to resolve disputes, if any, among the Distributory Committees;  
      (f) to promote economy in the use of water;  
      (g)  to maintain accounts;  
      (h) to cause annual audit of its accounts;  
      (i) to maintain other records in such manner as may be prescribed;  
      (j) to conduct General Body meetings in such manner as may be prescribed;  
      (k) to cause regular water budgeting and also the periodical social audit in such manner as may be prescribed;  
      (l) to work with the Canal Officer duly empowered by the competent authority to estimate the water availability before each season in the entire project area of each irrigation system;  
      (m) to allocate water shares to each Distributory Committee and Water User Association and promote economy in the use of water; 31  
      (n) to establish bye- laws establishing rules and sanctions of the organisation for implementing the above functions  
  28. (1) The State Government may, by notification, appoint such officer from the Water Resources Department, or any other department, as it considers necessary, to be the competent authority for every farmers’ organisation for the purposes of this Act. Appointment of competent authority

    (2) The competent authority appointed under sub-­section (1) shall be responsible to the respective farmers’ organisations in the implementation and execution of all decisions taken by the farmers’ organisation in the prescribed manner and shall provide technical advice and ensure that the work is executed in accordance with the technical parameters.  
  29. (1) The State Government or Competent Authority through a written Order may give directions to any farmers organisation relating to carrying out of duties or functions of the farmers organisation under this Act where such duties or functions are not being performed in an appropriate manner and where the State Government or the Competent Authority deems that the execution of such duties and functions is essential in public interest.     (2) The farmers’ organisation shall be bound to give effect to the directions made under sub­section (1) and if it fails to do so the State Government or the Competent Authority shall have the power to cause the carrying out of such duties and functions and from the funds of the farmers organisation, if any incurred and in the exercise of such power the State Government or the Competent Authority shall have the same power as would have been available with the farmers’ organisation under the Act.   
  30. (1) The State Government or the Competent Authority under this Act by a written order and with reasons therein, suspend any resolution or order or the effect of a permission or the carrying out of a function of a farmers’ organisation, if in its opinion­ Power to Suspend the Effect of

      (a) Such Resolution, Order, permission or function has not been adopted, agreed or arrived at through the due legal process; Appointment of competent authority and his function Power of the State Government to Execute some of the Works of the Farmers Organisation  
      (b) Such Resolution, Order, permission or function is beyond the powers vested under this Act or is contrary to an any law in force;  
      (c) The execution of such Resolution, Order or continuance of permission may lead to –  
         (i) The misappropriation, mis­utilisation or damage of funds vested in a farmers’ organisation or damage to property vested in such organisation;  
        (II) adverse impact on public health and convenience.  
    (2) The Competent Authority on making of an order under sub section (1) shall place before the State level Policy Committee constituted under this Act a copy of the Order along with the reasons for it as early as possible and in no case later than ten days from the date of the making of the Order and the State Level Policy Committee would approve the Order or set it aside or review it or modify it or may direct that the Order made with or without modification could continue to be in force for the period as the State Level Policy Committee may deem appropriate :
Provided that the approval, setting aside, review or  modification of the Order under this Section by the State  Level Policy Committee for this purpose shall not be made  unless the concerned farmers’ organisation is given appropriate opportunity of hearing against the Order made under sub section (1) and before the State Government or the Competent Authority.
 
   
CHAPTER  ­IV – FUNDS AND RESOURCES OF FARMERS’
ORGANISATION
 
   
Resources of farmers’ Organisation 31. (1) The funds of the farmers’ organisation shall comprise of the following namely: –;    
      (a) grants and commission received from the State Government as a share of the Irrigation Water Rate collected in the area of operation of the farmers’ organisation    
      (b) such other funds as may be granted by the  State Government and Central Government for the development of the area of operation;    
      (c) resources raised from any financing agency for undertaking any economic development activities in its area of operation;    
      (d) income from the properties and assets attached to the irrigation system;    
      (e) fees collected by the farmers’ organisation for the services rendered in better management of the irrigation system; and    
      (f) amounts received from any other sources.    
    (2) The State Government may authorize the farmers’ organisation to have their own resources for the maintenance of their irrigation system and growth of such farmers’ organisation.    
    (3) The water charges collected by the Water Users’ Association shall be deposited with the treasury of the State Government and on such deposit a minimum of   twenty five percent of the deposited amount shall be assigned to the said Water Users’ Association in prescribed manner Provided further that the amounts assigned to the Distributory Committee and the Project Committee shall be as prescribed by rules made under the Act.    
  32. A farmers’ organisation may for carrying out its objects and functions under this Act, levy and collect such fee as may be decided by the organisation from time to time. Power to levy and collect fee  
  33. The funds received, raised and generated by the Water Users’ Association shall be utilized to fulfil the objects of the Water Users’ Association in the prescribed manner. Utilization of Funds for Water Users’

  34. Every farmers’ organisation shall get its accounts audited. by independent auditor/s once in a year in the manner prescribed Audi
  35. (1) The farmers’ organisation shall keep their funds in a Nationalised Bank or a Co­operative Bank. Power to levy and collect fee

    (2) The funds shall be applied towards meeting of the expenses incurred by the Managing Committee of the concerned farmers’ organisation in the administration of this Act and for no other purpose. Sinking fund  
Sinking fund 36. (1) The Managing Committee of the farmers’ organisation shall maintain a sinking fund for the repayment of moneys borrowed and shall pay every year into the sinking fund such sum as may be sufficient for repayment within the period fixed of all moneys so borrowed  
    (2) The sinking fund or any part thereof shall be applied in or towards, the discharge of the loan for which such fund was created, and until such loan is wholly discharged it shall not be applied for any other purpose. Budget  
Budget 37 The Managing Committee of a farmers’ organisation shall prepare in such form in every financial year a budget in respect of the next financial year, showing the estimated receipts and expenditure of the Committee and shall place before the general body of the farmers’ organisation for its approval in such manner as may be prescribed. Recovery of dues 38 All the amounts payable or due to a farmers’ organisation shall be recoverable as arrears of land revenue.  
 
CHAPTER-V – OFFENCES AND PENALTIES
 
Offences and Penalties 39. Whoever without any lawful authority does any of the following acts, that is to say: ­  
      (a) canal; damages, alters, enlarges or obstructs any  
      (b) interferes with, increases or diminishes the supply of water in, or the flow of water from, through, over or under any canal;  
       (c) interferes with or alters the flow of water in any river or stream, so as to endanger, damage or render less useful any canal;  
      (d) being responsible for the maintenance of water course or using water course neglects to take proper precautions for the prevention of waste of water thereof, or interferes with the authorised distribution of the water therefrom or uses such water in an unauthorised manner;  
      (e) receiving water in his fields for irrigation, neglects to take proper precautions for the prevention of waste of such water;  
      (f) corrupts or fouls the water of any canal so as to render it less fit for the purposes for which it is ordinarily used;  
      (g) being a permanent holder, occupier, cultivator or agricultural labourer, resident in a village in which a proclamation under Section 36 of the Chhattisgarh Irrigation Act, 1931 (No. 3 of 1931) has been made, neglects to carry out the duties allotted to him;  
      (h) destroys, injures, defaces or removes any land mark, level mark, water gauge or other apparatus fixed by the authority of a caal officer;  
      (i) causes animals or vehicles to pass on or across any of the works, banks or channels or any canal after such passage has been prohibited by a canal officer;  
      (j) causes or knowingly and wilfully permits animals to graze or be tethered upon the bank or border of any canal after such grazing or tethering has been prohibited by a canal officer;  
      (k) removes or injures any tree, bush, grass or other vegetation growing on any canal; or  
      (l) eases himself on the banks or in the channel of a canal, shall on complaint made by a farmer’s organisation:­  
        (I) be punishable in respect of all offences mentioned in clauses (a) to (h), with imprisonment which may extend to two years, or with fine which shall not be less than one thousand Rupees but which may extend to five thousand Rupees or with both; and when the offence is a continuing one, with an additional fine not exceeding twenty rupees for every day after the first during which the offence has been persisted

40. (1)  State Government may dissolve a Management Committee of a farmers' organisation if such a Committee is found to be committing or have committed a gross misappropriation of Government funds.  
    (2) The dissolution of Management Committee under sub section (1) shall be carried out following an investigation and enquiry and after serving a notice to such a Committee and receipt of reply from the Committee to the notice so served; Provided that where the Management Committee fails to reply to the notice served upon it within a reasonable time or as may be prescribed, the dissolution may be carried out without waiting for the receipt of reply from such Committee.  
Punishment under other laws not barred 41. Nothing in this Act shall prevent any person from beingprosecuted and punished under any other law for the time being in force for any act or omission made punishable by or under this Act: Provided that no person shall be prosecuted and punished for the same offence more than once. Composition of offences 42. (1) A farmers’ organisation may accept from any person who committed or in respect of whom a reasonable belief can be inferred that he has committed an offence punishable under this Act or the rules made there under, a sum of money not less than rupees one thousand in case of offences mentioned in clause (a) to (h) of Section 39 and Rs. Five hundred for the offences mentioned in clause (i) to (l) of Section 39 by way of composition.  
    (2) On payment of such sum of money, no further proceedings shall be taken against him/her in regard to the offence, so compounded by the farmers’ organisations.  
 
CHAPTER-VI – SETTLEMENT OF DISPUTES
 
  43. (1) Any dispute of difference touching the constitution, management, powers or functions of a farmers’ organization arising between members shall be determined by the Managing Committee of the farmers’ organisation: Provided that for resolution of such disputes a separate Sub-Committee may be constituted under the rules made under the Act. Settlement of disputes
    (2) Any such dispute or difference arising between a member and the Managing Committee of a Water Users’ Association or between two or more Water Users’ Associations shall be determined by the Managing Committee of the Distributory Committee.  
    (3) Any such dispute or difference arising between a member and the Managing Committee of a Distributory Committee or between two or more Distributory Committees shall be determined by the Managing Committee of the Project Committee.  
    (4) Any such dispute or difference arising between a member and the Managing Committee of a project committee or between two or more project committees shall be determined by the State Level Policy Committee, whose decision shall be final  
    (5) Every dispute or difference under this section shall be disposed of within fifteen days from the date of reference of the dispute or difference. Settlement of disputes  
  44. (1) A party to a dispute or difference aggrieved by any decision made or order passed by the Managing Committee of a Water Users’ Association may appeal to the Managing Committee of the Distributory Committee, whose decision thereon shall be final. Appeals
    (3) Any party to a dispute or difference aggrieved by any decision made or order passed by the Managing Committee of a Project Committee may appeal to the State Level Policy ommittee, whose decision thereon shall be final.  
    (4) Every appeal under sub-section (1) or sub-section (2) or sub-section (3) shall be preferred within 15 days of communication of the decision or the order to the person aggrieved.  
    (5) Every appeal under this section shall be disposed of within 15 days from the date of filing of the appeal.  
         

 

CHAPTER-VII – MISCELLANEOUS
Records 45. (1) Every farmers’ organisation shall keep at its office the following accounts, record and documents, namely: -  
      (a) a map of the area of operation of the
farmers’ organisation along with map of the structures and distributory networks prepared in consultation with the Water Resources Department;
 
      (b) a statement of the assets and liabilities;  
      (c) an activity plan including seasonal
irrigation schedules, cropping calendar and decisions related to important aspects of irrigation management and irrigated agriculture;
 
      (d) minutes book;  
      (e) books of account showing receipt and
payments;
 
      (f)  books of account of all purchases and sales of goods by the farmers’ organisation;  
      (g) register of measurement books, level field books, work orders and the like;  
      (h) copies of audit reports and enquiry reports;  
      (i) all such other accounts, records and
documents as may be prescribed from time to time;
 
      (j) stock register;  
      (k) list of users with details of land holding;  
      (l) register of penalties;  
    (2) The books of accounts and other records shall be open for information to the members of the farmers’ organisation.  
  46. The meetings of the farmers’ organisation and the Managing Committees thereof at such intervals, the procedure, the presidency and the quorum there of shall be, such as may be prescribed. Meetings
  47. (1) A member of the Managing Committee of a farmers’ organisation may resign his office by a letter sent by registered post or tendered in person to the President of the managing committee concerned. Resignation
    (2) The President of the Managing Committee of a Water Users’ Association may resign his office by a letter sent by registered post or tendered in person to the President of the Distributory Committee concerned.  
    (3) The President of the Managing Committee of a Distributory Committee may resign his office by a letter sent by registered post or tendered in person to the President of the Project Committee concerned.  
    (4) The President of the Managing Committee of a Project Committee may resign his office by a letter sent by registered post or tendered in person to the Managing Committee of such Project Committee.  

 

  48. (1)  The State Government may by notification, appoint controlling officers not below the rank of the Secretary to the Government to exercise the general control and superintendence over the competent authorities and the District Collectors in performance of their functions under this Act or rules made thereunder.   49. The Government may, by notification, appoint an officer or officers to exercise the powers and perform the functions of a farmers’ organisation and the Managing Committee there of till such time such farmers’  organisation is duly constituted or reconstituted and such Managing Committee assumes office under the provisions of this Act. 50. All permissions, orders, decisions and other documents of the farmers’ organisation shall be authenticated by the signature of the President of the farmers’ organisation or any other member of the Managing Committee authorized by the Managing Committee in this behalf.

51. No act or proceedings of the Managing Committee of a farmers’ organisation shall be invalid by reason only of the existence of any vacancy in, or defect in the constitution of the said committee.

52. (1) No suit, prosecution or other legal proceedings
shall be instituted against any person for anything which is in good faith, done or intended to be done under this Act or under the rules made thereunder.

53. (1)  If any difficulty arises in giving effect to the
provisions of this Act or as to the first constitution or reconstitution of any farmers’ organisation after the commencement of this Act, the Government, in consultation with the respective farmers’ organisation and the higher-level farmers’ organisations, and as the
occasion may require by order published in the Official Gazette, do anything which appears to  them necessary for removing the difficulty.
 
    (2) All orders made under sub-section (1) shall as soon as may be laid on the table of the Vidhan Sabha.  
Saving 54. Nothing contained in this Act shall affect the rights or properties vested in a Gram Panchayat, Janpad Panchayat, Zila Panchayat, Nagar Panchayat, Municipal Council or Municipal Corporation under any law for the  time being in force.  
Power to make rules 55. (1) The State Government may, by notification in the Official Gazette, make rules to carry out the purposes of this Act.  
    (2) Every rule made under this Act shall as soon as after it is made be laid before Vidhan Sabha.    
  56. (1) The State Government shall publish model byelaws for Water Users’ Association ncluding model regulations for guidance and adoption by the Water Users’ Association. Power to make

    (2) The Water Users’ Association shall adopt the
model Bye-laws and regulations with necessary modifications as it deems  appropriate subject to the provisions of the Act and not contrary to the essential nature and purpose of the model bye-laws and egulations
 
  57. The Chhattisgarh Sinchai Prabandhan Me Krishkon Ki Bhagidari Adhiniyam 1999 (No. 23 of 1999) and orders resolution if any, in force immediately before the commencement of this Act, are hereby repealed or rescinded, as the case may be, in respect of matters covered by this Act.
Provided that any order made or action taken under the Act so repealed shall be deemed to have been made or taken under the corresponding provisions of this Act.

STATEMENT OF OBJECTS AND REASONS
 

Irrigation management is a key to sustain the development of agriculture in Chhattisgarh. The Chhattisgarh government has found it desirable and essential that management of irrigation system is restructured to make water management more efficient with farmers’ participation. This is also a mandate of under the National Water Policy 2002.

This legislation introduces a participatory management process involvi ng farmers in all phases of irrigation management including planning and delineation of water users’ area, designing, operation, maintenance, rehabilitation, modernization, administering rights, resolving of conflicts, determination and collection of Water Tax, monitoring, evaluation and financial management including  providing/coordinating activities of irrigated agriculture. It is believed that such a regime can lead to an economic upliftment of the farmers of the State and increase Government revenue through a rise in the collection of water charges. Further, the Act provides for more inclusive and equitable Water Users’ Association, especially with increased representation of women and the landless. There is a mandate for more optimal / smaller sizes of Water Users Associations in the Minor Irrigation Systems and separate Water Users’ Association for lift systems. The Act also provides for a State level Farmers federation to facilitate interactions with the State government and other agencies.

THE RIGHT TO INFORMATION ACT, 2005 No. 22 of 2005

An Act to provide for setting out the practical regime of right to information for citizens to secure access to information under the control of public authorities, in order to promote transparency and accountability in the working of every public authority, the constitution of a Central Information Commission and State Information Commissions and for matters connected therewith or incidental thereto.

 

WHEREAS the Constitution of India has established democratic Republic;

 

AND WHEREAS democracy requires an informed citizenry and transparency of information which are vital to its functioning and also to contain corruption and to hold Governments and their instrumentalities accountable to the governed;

 

AND WHEREAS revelation of information in actual practice is likely to conflict with other public interests including efficient operations of the Governments, optimum use of limited fiscal resources and the preservation of confidentiality of sensitive information;

 

AND WHEREAS it is necessary to harmonise these conflicting interests while preserving the paramountcy of the democratic ideal;

 

NOW, THEREFORE, it is expedient to provide for furnishing certain information to citizens who desire to have it.

 

BE it enacted by Parliament in the Fifty-sixth Year of the Republic of India as follows:—

 

 

 


 

CHAPTER II

Right to information and obligations of public authorities

 

 

3. Subject to the provisions of this Act, all citizens shall have the right to information.

Right to information

 

4. (1) Every public authority shall—

 

a) maintain all its records duly catalogued and indexed in a manner and the form which facilitates the right to information under this Act and ensure that all records that are appropriate to be computerised are, within a reasonable time and subject to availability of resources, computerised and connected through a network all over the country on different systems so that access to such records is facilitated;

 

b) publish within one hundred and twenty days from the enactment of this Act,—

 

(i) the par ticulars of its organisation, functions and duties;

 

(ii) the powers and duties of its officers and employees;

 

(iii) the procedure followed in the decision making process, including channels of supervision and accountability;

 

(iv) the norms set by it for the discharge of its functions;

 

(v) the rules, regulations, instructions, manuals and records, held by it or under its control or used by its employees for discharging its functions;

 

(vi) a statement of the categories of documents that are held by it or under its control;

 

(vii) the particulars of any arrangement that exists for consultation with, or representation by, the members of the public in relation to the formulation of its policy or implementation thereof;

 

(viii) a statement of the boards, councils, committees and other bodies consisting of two or more persons constituted as its part or for the purpose of its advice, and as to whether meetings of those boards, councils, committees and other bodies are open to the public, or the minutes of such meetings are accessible for public;

 

(ix) a directory of its officers and employees;

 

(x) the monthly remuneration received by each of its officers and employees, including the system of compensation as provided in its regulations;nbsp;

 

(xi) the budget allocated to each of its agency, indicating the particulars of all plans, proposed expenditures and reports on disbursements made;

 

(xii) the manner of execution of subsidy programmes, including the amounts allocated and the details of beneficiaries of such programmes;

 

(xiii) particulars of recipients of concessions, permits or authorisations granted by it;

 

(xiv) details in respect of the information, available to or held by it, reduced in an electronic form;

 

(xv) the particulars of facilities available to citizens for obtaining information, including the working hours of a library or reading room, if maintained for public use;

 

(xvi) the names, designations and other particulars of the Public Information Officers;

 

(xvii) such other information as may be prescribed; and thereafter update these publications every year;

 

c) publish all relevant facts while formulating important policies or announcing the decisions which affect public;

 

d) provide reasons for its administrative or quasi-judicial decisions to affected persons.

 

(2) It shall be a constant endeavour of every public authority to take steps in accordance with the requirements of clause (b) of sub-section (1) to provide as much information suo motu to the public at regular intervals through various means of communications, including internet, so that the public have minimum resort to the use of this Act to obtain information.

 

(3) For the purposes of sub-section (1), every information shall be disseminated widely and in such form and manner which is easily accessible to the public.

 

(4) All materials shall be disseminated taking into consideration the cost effectiveness, local language and the most effective method of communication in that local area and the information should be easily accessible, to the extent possible in electronic format with the Central Public Information Officer or State Public Information Officer, as the case may be, available free or at such cost of the medium or the print cost price as may be prescribed.

 

Explanation.—For the purposes of sub-sections (3) and (4), "disseminated" means making known or communicated the information to the public through notice boards, newspapers, public announcements, media broadcasts, the internet or any other means, including inspection of offices of any public authority.

 

 

 

5. (1) Every public authority shall, within one hundred days of the enactment of this Act, designate as many officers as the Central Public Information Officers or State Public Information Officers, as the case may be, in all administrative units or offices under it as may be necessary to provide information to persons requesting for the information under this Act.

 

(2) Without prejudice to the provisions of sub-section (1), every public authority shall designate an officer, within one hundred days of the enactment of this Act, at each sub-divisional level or other sub-district level as a Central Assistan Public Information Officer or a State Assistant Public Information Officer, as the case may be, to receive the applications for information or appeals under this Act for forwarding the same forthwith to the Central Public Information Officer or the State Public Information Officer or senior officer specified under sub-section (1) of section 19 or the Central Information Commission or the State Information Commission, as the case may be:

 

Provided that where an application for information or appeal is given to a Central Assistant Public Information Officer or a State Assistant Public Information Officer, as the case may be, a period of five days shall be added in computing the period for response specified under sub-section (1) of section 7.

 

(3) Every Central Public Information Officer or State Public Information Officer, as the case may be, shall deal with requests from persons seeking information and render reasonable assistance to the persons seeking such information.

 

(4) The Central Public Information Officer or State Public Information Officer, as the case may be, may seek the assistance of any other officer as he or she considers it necessary for the proper discharge of his or her duties.

 

(5) Any officer, whose assistance has been sought under sub-section (4), shall render all assistance to the Central Public Information Officer or State Public Information Officer, as the case may be, seeking his or her assistance and for the purposes of any contravention of the provisions of this Act, such other officer shall be treated as a Central Public Information Officer or State Public Information Officer, as the case may be.

Designation of Public Information Officers.

 

6. (1) A person, who desires to obtain any information under this Act, shall make a request in writing or through electronic means in English or Hindi or in the official language of the area in which the application is being made, accompanying such fee as may be prescribed, to—

 

(a) the Central Public Information Officer or State Public Information Officer, as the case may be, of the concerned public authority;

 

(b) the Central Assistant Public Information Officer or State Assistant Public Information Officer, as the case may be,

specifying the particulars of the information sought by him or her:

Provided that where such request cannot be made in writing, the Central Public Information Officer or State Public Information Officer, as the case may be, shall render all reasonable assistance to the person making the request orally to reduce the same in writing.

(2) An applicant making request for information shall not be required to give any reason for requesting the information or any other personal details except those that may be necessary for contacting him.

(3) Where an application is made to a public authority requesting for an information,—

 

(i) which is held by another public authority; or

 

(ii) the subject matter of which is more closely connected with the functions of another public authority,

 

the public authority, to which such application is made, shall transfer the application or such part of it as may be appropriate to tha other public authority and inform the applicant immediately about such transfer:

Provided that the transfer of an application pursuant to this sub-section shall be made as soon as practicable but in no case later than five days from the date of receipt of the application.

Disposal of request.

7. (1) Subject to the proviso to sub-section (2) of section 5 or the proviso to sub-section (3) of section 6, the Central Public Information Officer or State Public Information Officer, as the case may be, on receipt of a request undersection 6 shall, as expeditiously as possible, and in any case within thirty days of the receipt of the request, either provide the information on payment of such fee as may be prescribed or reject the request for any of the reasons specified in sections 8 and 9:

Provided that where the information sought for concerns the life or liberty of a person, the same shall be provided within forty-eight hours of the receipt of the request.

(2) If the Central Public Information Officer or State Public Information Officer, as the case may be, fails to give decision on the request for information within the period specified under sub-section (1), the Central Public Information Officer or State Public Information Officer, as the case may be, shall be deemed to have refused the request.

(3) Where a decision is taken to provide the information on payment of any further fee representing the cost of providing the information, the Central Public Information Officer or State Public Information Officer, as the case may be, shall send an intimation to the person making the request, giving—

(a) the details of further fees representing the cost of providing the information as determined by him, together with the calculations made to arrive at the amount in accordance with fee prescribed under sub-section (1), requesting him to deposit that fees, and the period intervening between the despatch of the said intimation and payment of fees shall be excluded for the purpose of calculating the period of thirty days referred to in that sub-section;

(b) information concerning his or her right with respect to review the decision as to the amount of fees charged or the form of access provided, including the particulars of the appellate authority, time limit, process and any other forms.

(4) Where access to the record or a part thereof is required to be provided under this Act and the person to whom access is to be provided is sensorily disabled, the Central Public Information Officer or State Public Information Officer, as the case may be, shall provide assistance to enable access to the information, including providing such assistance as may be appropriate for the inspection.

(5) Where access to information is to be provided in the printed or in any electronic format, the applicant shall, subject to the provisions of sub-section (6), pay such fee as may be prescribed:

Provided that the fee prescribed under sub-section (1) of section 6 and sub-sections (1) and (5) of section 7 shall be reasonable and no such fee shall be charged from the persons who are of below poverty line as may be determined by the appropriate Government.

(6) Notwithstanding anything contained in sub-section (5), the person making request for the information shall be provided the information free of charge where a public authority fails to comply with the time limits specified in sub-section (1).

(7) Before taking any deciion under sub-section (1), the Central Public Information Officer or State Public Information Officer, as the case may be, shall take into consideration the representation made by a third party under section 11.

(8) Where a request has been rejected under sub-section (1), the Central Public Information Officer or State Public Information Officer, as the case may be, shall communicate to the person making the request,—

 

(i) the reasons for such rejection;

 

(ii) the period within which an appeal against such rejection may be preferred; and

 

(iii) the particulars of the appellate authority.

 

(9) An information shall ordinarily be provided in the form in which it is sought unless it would disproportionately divert the resources of the public authority or would be detrimental to the safety or preservation of the record in question.

 

 

 

8. (1) Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen,—

(a) information, disclosure of which would prejudicially affect the sovereignty and integrity of India, the security, strategic, scientific or economic interests of the State, relation with foreign State or lead to incitement of an offence;

 

(b) information which has been expressly forbidden to be published by any court of law or tribunal or the disclosure of which may constitute contempt of court;

 

(c) information, the disclosure of which would cause a breach of privilege of Parliament or the State Legislature;

 

(d) information including commercial confidence, trade secrets or intellectual property, the disclosure of which would harm the competitive position of a third party, unless the competent authority is satisfied that larger public interest warrants the disclosure of such information;

 

(e) information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information;

 

(f) information received in confidence from foreign Government;

 

(g) information, the disclosure of which would endanger the life or physical safety of any person or identify the source of information or assistance given in confidence for law enforcement or security purposes;

 

(h) information which would impede the process of investigation or apprehension or prosecution of offenders;

 

(i) cabinet papers including records of deliberations of the Council of Ministers, Secretaries and other officers:

Provided that the decisions of Council of Ministers, the reasons thereof, and the material on the basis of which the decisions were taken shall be made public after the decision has been taken, and the matter is complete, or over:

Provided further that those matters which come under the exemptions specified in this section shall not be disclosed;

 

(j) information which relates to personal information the disclosure of which has no relationship to any public actiity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information:

Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person.

(2) Notwithstanding anything in the Official Secrets Act, 1923 nor any of the exemptions permissible in accordance with sub-section (1), a public authority may allow access to information, if public interest in disclosure outweighs the harm to the protected interests.

 

(3) Subject to the provisions of clauses (a), (c) and (i) of sub-section (1), any information relating to any occurrence, event or matter which has taken place, occurred or happened twenty years before the date on which any request is made under secton 6 shall be provided to any person making a request under that section:

 

 

 

Provided that where any question arises as to the date from which the said period of twenty years has to be computed, the decision of the Central Government shall be final, subject to the usual appeals provided for in this Act.

 

Grounds for rejection to access in certain cases.

9. Without prejudice to the provisions of section 8, a Central Public Information Officer or a State Public Information Officer, as the case may be, may reject a request for information where such a request for providing access would involve an infringement of copyright subsisting in a person other than the State.

 

Severability

10. (1) Where a request for access to information is rejected on the ground that it is in relation to information which is exempt from disclosure, then, notwithstanding anything contained in this Act, access may be provided to that part of the record which does not contain any information which is exempt from disclosure under this Act and which can reasonably be severed from any part that contains exempt information.

 

(2) Where access is granted to a part of the record under sub-section (1), the Central Public Information Officer or State Public Information Officer, as the case may be, shall give a notice to the applicant, informing—

 

(a) that only part of the record requested, after severance of the record containing information which is exempt from disclosure, is being provided;

 

(b) the reasons for te decision, including any findings on any material question of fact, referring to the material on which those findings were based;

 

(c) the name and designation of the person giving the decision;

 

(d) the details of the fees calculated by him or her and the amount of fee which the applicant is required to deposit; and

 

(e) his or her rights with respect to review of the decision regarding non-disclosure of part of the information, the amount of fee charged or the form of access provided, including the particulars of the senior officer specified under sub-section (1) of section 19 or the Central Information Commission or the State Information Commission, as the case may be, time limit, process and any other form of access.

 

Third party information.

11. (1) Where a Central Public Information Officer or a State Public Information Officer, as the case may be, intends to disclose any information or record, or part thereof on a request made under this Act, which relates to or has been supplied by a third party and has been treated as confidential by that third party, the Central Public Information Officer or State Public Information Officer, as the case may be, shall, within five days from the receipt of the request, give a written notice to such third party of the request and of the fact that the Central Public Information Officer or State Public Information Officer, as the case may be, intends to disclose the information or record, or part thereof, and invite the third party to make a submission in writing or orally, regarding whether the information should be disclosed, and such submission of the third party shall be kept in view while taking a decision about disclosure of information:

Provided that except in the case of trade or commercial secrets protected by law, disclosure may be allowed if the public interest in disclosure outweighs in importance any possible harm or injury to the interests of such third party.

 

(2) Where a notice is served by the Central Public Information Officer or State Public Information Officer, as the case may be, under sub-section (1) to a third party in respect of any information or record or part thereof, the third party shall, within ten days from the date of receipt of such notice, be given the opportunity to make representation against the proposed disclosure.

 

(3) Notwithstanding anything contained in section 7, the Central Public Information Officer or State Public Information Officer, as the case may be, shall, within forty days after receipt of the request under section 6, if the third party has been given an opportunity to make representation under sub-section (2), make a decision as to whether or not to disclose the information or record or part thereof and give in writing the notice of his decision to the third party.

 

(4) A notice given under sub-section (3) shall include a statement that the third party to whom the notice is given is entitled to prefer an appeal under section 19 against the decision.

 

 

 

 

CHAPTER III

The Central Information Commission

 

 

12. (1) The Central Government shall, by notification in the Official Gazette, constitute a body to be known as the Central Information Commission to exercise the powers conferred on, and to perform the functions assigned to, it under this Act.

(2) The Central Information Commission shall consist of—

 

(a) the Chief Information Commissioner; and

 

(b) such number of Central Information Commissioners, not exceeding ten, as may be deemed necessary.

 

(3) The Chief Information Commissioner and Information Commissioners shall be appointed by the President on the recommendation of a committee consisting of—

 

(i) the Prime Minister, who shall be the Chairperson of the committee;

 

(ii) the Leader of Opposition in the Lok Sabha; and

 

(iii) a Union Cabinet Minister to be nominated by the Prime Minister.

 

Explanation.—For the purposes of removal of doubts, it is hereby declared that where the Leader of Opposition in the House of the People has not been recognised as such, the Leader of the single largest group in opposition of the Government in the House of the People shall be deemed to be the Leader of Opposition.

(4) The general superintendence, direction and management of the affairs of the Central Information Commission shall vest in the Chief Information Commissioner who shall be assisted by the Information Commissioners and may exercise all such powers and do all such acts and things which may be exercised or done by the Central Information Commission autonomously without being subjected to directions by any other authority under this Act.

 

(5) The Chief Information Commissioner and Information Commissioners shall be persons of eminence in public life with wide knowledge and experience in law, science and technology, social service, management, journalism, mass media or administration and governance.

 

(6) The Chief Information Commissioner or an Information Commissioner shall not be a Member of Parliament or Member of the Legislature of any State or Union territory, as the case may be, or hold any other office of profit or connected with any political party or carrying on any business or pursuing any profession.

 

(7) The headquarters of the Central Information Commission shall be at Delhi and the Central Information Commission may, with the previous approval of the Central Government, establish offices at other places in India.

 

Constitution of Central Information Commission.

 

13. (1) The Chief Information Commissioner shall hold office for a term of five years from the date on which he enters upon his office and shall not be eligible for reappointment:

Provided that no Chief Information Commissioner shall hold office as such afterhe has attained the age of sixty-five years.

 

(2) Every Information Commissioner shall hold office for a term of five years from the date on which he enters upon his office or till he attains the age of sixty-five years, whichever is earlier, and shall not be eligible for reappointment as such Information Commissioner:

Provided that every Information Commissioner shall, on vacating his office under this sub-section be eligible for appointment as the Chief Information Commissioner in the manner specified in sub-section (3) of section 12:

Provided further that where the Information Commissioner is appointed as the Chief Information Commissioner, his term of office shall not be more than five years in aggregate as the Information Commissioner and the Chief Information Commissioner.

 

(3) The Chief Information Commissioner or an Information Commissioner shall before he enters upon his office make and subscribe before the President or some other person appointed by him in that behalf, an oath or affirmation according to the form set out for the purpose in the First Schedule.

 

(4) The Chief Information Commissioner or an Information Commissioner may, at any time, by writing under his hand addressed to the President, resign from his office:

Provided that the Chief Information Commissioner or an Information Commissioner may be removed in the manner specified under section 14.

 

(5) The salaries and allowances payable to and other terms and conditions of service of—

 

(a) the Chief Information Commissioner shall be the same as that of the Chief Election Commissioner;

 

(b) an Information Commissioner shall be the same as that of an Election Commissioner:

 

Provided that if the Chief Information Commissioner or an Information Commissioner, at the time of his appointment is, in receipt of a pension, other than a disability or wound pension, in respect of any previous service under the Government of India or under the Government of a State, his salary in respect of the service as the Chief Information Commissioner or an Information Commissioner shall be reduced by the amount of that pension including any portion of pension which was commuted and pension equivalent of other forms of retirement benefits excluding pension equivalent of retirement gratuity:

Provided further that if the Chief Information Commissioner or an Information Commissioner if, at the time of his appointment is, in receipt of retirement benefits in respect of any previous service rendered in a Corporation established by or under any Central Act or State Act or a Government company owned or controlled by the Central Government or the State Government, his salary in respect of the service as the Chief Information Commissioner or an Information Commissioner shall be reduced by the amount of pension equivalent to the retirement benefits:

Provided also that the salaries, allowances and other conditions of service of the Chief Information Commissioner and the Information Commissioners shall not be varied to their disadvantage after their appointment.

(6) The Central Government shall provide the Chief Information Commissioner and the Information Commissioners with such officers and employees as may be necessary for the efficient performance of their functions under this Act, and the salaries and allowances payable to and the terms and conditions of service of the officers and other employees appointed for the purpose of this Act shall be such as may be prescribed.

 

Term of office and conditions of service.

 

14. (1) Subject to the provisions of sub-section (3), the Chief Information Commissioner or any Information Commissioner shall be removed from his office only by order of the President on the ground of proved misbehaviour or incapacity after the Supreme Court, on a reference made to it by the President, has, on inquiry, reported that the Chief Information Commissioner or any Information Commissioner, as the case may be, ought on such ground be removed.

 

(2) The President may suspend from office, and if deem necessary prohibit also from attending the office during inquiry, the Chief Information Commissioner or Information Commissioner in respect of whom a reference has been made to the Supreme Court under sub-section (1) until the President has passed orders on receipt of the report of the Supreme Court on such reference.

 

(3) Notwithstanding anything contained in sub-section (1), the President may by order remove from office the Chief Information Commissioner or any Information Commissioner if the Chief Information Commissioner or a Information Commissioner, as the case may be,—

 

(a) is adjudged an insolvent; or

 

(b) has been convicted of an offence which, in the opinion of the President, involves moral turpitude; or

 

(c) engages during his term of office in any paid employment outside the duties of his office; or

 

(d) is, in the opinion of the President, unfit to continue in office by reason of infirmity of mind or body; or

 

(e) has acquired such financial or other interest as is likely to affect prejudicially his functions as the Chief Information Commissioner or a Information Commissioner.

 

(4) If the Chief Information Commissioner or a Information Commissioner in any way, concerned or interested in any contract or agreement made by or on behalf of the Government of India or participates in any way in the profit thereof or in any benefit or emolument arising therefrom otherwise than as a member and in common with the other members of an incorporated company, he shall, for the purposes of sub-section (1), be deemed to be guilty of misbehaviour.

CHAPTER IV

The State Information Commission

 

 

15. (1) Every State Government shall, by notification in the Official Gazette, constitute a body to be known as the ......... (name of the State) Information Commission to exercise the powers conferred on, and to perform the functions assigned to, it under this Act.

(2) The State Information Commission shall consist of—

 

(a) the State Chief Information Commissioner, and

 

(b) such number of State Information Commissioners, not exceeding ten, as may be deemed necessary.

 

(3) The State Chief Information Commissioner and the State Information Commissioners shall be appointed by the Governor on the recommendation of a committee consisting of—

 

(i) the Chief Minister, who shall be the Chairperson of the committee;

 

(ii) the Leader of Opposition in the Legislative Assembly; and

 

(iii) a Cabinet Minister to be nominated by the Chief Minister

 

Explanation.—For the purposes of removal of doubts, it is hereby declared that where the Leader of Opposition in the Legislative Assembly has not been recognised as such, the Leader of the single largest group in opposition of the Government in the Legislative Assembly shall be deemed to be the Leader of Opposition.

(7) The headquarters of the State Information Commission shall be at such place in the State as the State Government may, by notification in the Official Gazette, specify and the State Information Commission may, with the previous approval of the State Government, establish offices at other places in the State.

Term of office and conditions of service.

16. (1) The State Chief Information Commissioner shall hold office for a term of five years from the date on which he enters upon his office and shall not be eligible for reappointment:

 

Provided that no State Chief Information Commissioner shall hold office as such after he has attained the age of sixty-five years.

 

(2) Every State Information Commissioner shall hold office for a term of five years from the date on which he enters upon his office or till he attains the age of sixty-five years, whichever is earlier, and shall not be eligible for reappointment as such State Information Commissioner:

 

Provided that every State Information Commissioner shall, on vacating his office under this sub-section, be eligible for appointment as the State Chief Information Commissioner in the manner specified in sub-section (3) of section 15:

 

Provided further that where the State Information Commissioner is appointed as the State Chief Information Commissioner, his term of office shall not be more than five years in aggregate as the State Information Commissioner and the State Chief Information Commissioner.

 

(3) The State Chief Information Commissioner or a State Information Commissioner, shall before he enters upon his office make and subscribe before the Governor or some other person appointed by him in that behalf, an oath or affirmation according to the form set out for the purpose in the First Schedule.

 

(4) The State Chief Information Commissioner or a State Information Commissioner may, at any time, by writing under his hand addressed to the Governor, resign from his office:

 

Provided that the State Chief Information Commissioner or a State Information Commissioner may be removed in the manner specified under section 17.

 

(5) The salaries and allowances payable to and other terms and conditions of service of—

 

(a) the State Chief Information Commissioner shall be the same as that of an Election Commissioner;

 

(b) the State Information Commissioner shall be the same as that of the Chief Secretary to the State Government:

 

Provided that if the State Chief Information Commissioner or a State Information Commissioner, at the time of his appointment is, in receipt of a pension, other than a disability or wound pension, in respect of any previous service under the Government of India or under the Government of a State, his salary in respect of the service as the State Chief Information Commissioner or a State Information Commissioner shall be reduced by the amount of that pension including any portion of pension which was commuted and pension equivalent of other forms of retirement benefits excluding pension equivalent of retirement gratuity:

 

Provided further that where the State Chief Information Commissioner or a State Information Commissioner if, at the time of his appointment is, in receipt of retirement benefits in respect of any previous service rendered in a Corporation established by or under any Central Act or State Act or a Government company owned or controlled by the Central Government or the State Government, his salary in respect of the service as the State Chief Information Commissioner or the State Information Commissioner shall be reduced by the amount of pension equivalent to the retirement benefits:

 

Provided also that the salaries, allowances and other conditions of service of the State Chief Information Commissioner and the State Information Commissioners shall not be varied to their disadvantage after their appointment.

 

(6) The State Government shall provide the State Chief Information Commissioner and the State Information Commissioners with such officers and employees as may be necessary for the efficient performance o their functions under this Act, and the salaries and allowances payable to and the terms and conditions of service of the officers and other employees appointed for the purpose of this Act shall be such as may be prescribed.

 

 

 

17. (1) Subject to the provisions of sub-section (3), the State Chief Information Commissioner or a State Information Commissioner shall be removed from his office only by order of the Governor on the ground of proved misbehaviour or incapacity after the Supreme Court, on a reference made to it by the Governor, has on inquiry, reported that the State Chief Information Commissioner or a State Information Commissioner, as the case may be, ought on such ground be removed.

 

(2) The Governor may suspend from office, and if deem necessary prohibit also from attending the office during inquiry, the State Chief Information Commissioner or a State Information Commissioner in respect of whom a reference has been made to the Supreme Court under sub-section (1) until the Governor has passed orders on receipt of the report of the Supreme Court on such reference.

 

(3) Notwithstanding anything contained in sub-section (1), the Governor may by order remove from office the State Chief Information Commissioner or a State Information Commissioner if a State Chief Information Commissioner or a State Information Commissioner, as the case may be,—

CHAPTER V

Powers and functions of the Information Commissions, appeal and pnalties

 

 

 

18. (1) Subject to the provisions of this Act, it shall be the duty of the Central Information Commission or State Information Commission, as the case may be, to receive and inquire into a complaint from any person,—

 

(a) who has been unable to submit a request to a Central Public Information Officer or State Public Information Officer, as the case may be, either by reason that no such officer has been appointed under this Act, or because the Central Assistant Public Information Officer or State Assistant Public Information Officer, as the case may be, has refused to accept his or her application for information or appeal under this Act for forwarding the same to the Central Public Information Officer or State Public Information Officer or senior officer specified in sub-section (1) of section 19 or the Central Information Commission or the State Information Commission, as the case may be;

 

(b) who has been refused access to any information requested under this Act;

 

(c) who has not been given a response to a request for information or access to information within the time limit specified under this Act;

 

(d) who has been required to pay an amount of fee which he or she considers unreasonable;

 

(e) who believes that he or she has been given incomplete, misleading or false information under this Act; and

 

(f) in respect of any other matter relating to requesting or obtaining access to records under this Act.

 

(2) Where the Central Information Commission or State Information Commission, as the case may be, is satisfied that there are reasonable grounds to inquire into the matter, it may initiate an inquiry in respect thereof.

 

 

 

(3) The Central Information Commission or State Information Commission, as the case may be, shall, while inquiring into any matter under this section, have the same powers as are vested in a civil court while trying a suit under the Code of Civil Procedure, 1908, in respect of the following matters, namely:—

(a) summoning and enforcing the attendance of persons and compel them to give oral or written evidence on oath and to produce the documents or things;

 

(b) requiring the discovery and inspection of documents;

 

(c) receiving evidence on affidavit;

 

(d) requisitioning any public record or copies thereof from any court or office;

 

(e) issuing summons for examination of witnesses or documents; and

 

Appeal

19. (1) Any person who, does not receive a decision within the time specified in sub-section (1) or clause (a) of sub-section (3) of section 7, or is aggrieved by a decision of the Central Public Information Officer or State Public Information Officer, as the case may be, may within thirty days from the expiry of such period or from the receipt of such a decision prefer an appeal to such officer who is senior in rank to the Central Public Information Officer or State Public Information Officer as the case may be, in each public authority:

 

Provided that such officer may admit the appeal after the expiry of the period of thirty days if he or she is satisfied that the appellant was prevented by sufficient cause from filing the appeal in time.

 

(2) Where an appeal is preferred against an order made by a Central Public Information Officer or a State Public Information Officer, as the case may be, under section 11 to disclose third party information, the appeal by the concerned third party shall be made within thirty days from the date of the order.

 

(3) A second appeal against the decision under sub-section (1) shall lie within ninety days from the date on which the decision should have been made or was actually received, with the Central Information Commission or the State Information Commission:

 

Provided that the Central Information Commission or the State Information Commission, as the case may be, may admit the appeal after the expiry of the period of ninety days if it is satisfied that the appellant was prevented by sufficient cause from filing the appeal in time.

 

(4) If the decision of the Central Public Information Officer or State Public Information Officer, as the case may be, against which an appeal is preferred relates to information of a third party, the Central Information Commission or State Information Commission, as the case may be, shall give a reasonable opportunity of being heard to that third party.

 

(5) In any appeal proceedings, the onus to prove that a denial of a request was justified shall be on the Central Public Information Officer or State Public Information Officer, as the case may be, who denied the request.

 

(6) An appeal under sub-section (1) or sub-section (2) shall be disposed of within thirty days of the receipt of the appeal or within such extended period not exceeding a total of forty-five days from the date of filing thereof, as the case may be, for reasons to be recorded in writing.

(7) The decision of the Central Information Commission or State Information Commission, as the case may be, shall be binding.

 

(8) In its decision, the Central Information Commission or State Information Commission, as the case may be, hasthe power to—

(a) require the public authority to take any such steps as may be necessary to secure compliance with the provisions of this Act, including—

 

(i) by providing access to information, if so requested, in a particular form;

 

(ii) by appointing a Central Public Information Officer or State Public Information Officer, as the case may be;

 

(iii) by publishing certain information or categories of information;

 

(iv) by making necessary changes to its practices in relation to the maintenance, management and destruction of records;

 

(v) by enhancing the provision of training on the right to information for its officials;

 

(vi) by providing it with an annual report in compliance with clause (b) of sub-section (1) of section 4;

(b) require the public authority to compensate the complainant for any loss or other detriment suffered;

 

(c) impose any of the penalties provided under this Act;

 

(d) reject the application.

 

(9) The Central Information Commission or State Information Commission, as the case may be, shall give notice of its decision, including any right of appeal, to the complainant and the public authority.

 

(10) The Central Information Commission or State Information Commission, as the case may be, shall decide the appeal in accordance with such procedure as may be prescribed.

 

 

Penalties

20. (1) Where the Central Information Commission or the State Information Commission, as the case may be, at the time of deciding any complaint or appeal is of the opinion that the Central Public Information Officer or the State Public Information Officer, as the case may be, has, without any reasonable cause, refused to receive an application for information or has not furnished information within the time specified under sub-section (1) of section 7 or malafidely denied the request for information or knowingly given incorrect, incomplete or misleading information or destroyed information which was the subject of the request or obstructed in any manner in furnishing the information, it shall impose a penalty of two hundred and fifty rupees each day till application is received or information is furnished, so however, the total amount of such penalty shall not exceed twenty-five thousand rupees:

 

Provided that the Central Public Information Officer or the State Public Information Officer, as the case may be, shall be given a reasonable opportunity of being heard before any penalty is imposed on him:

 

Provided further that the burden of proving that he acted reasonably and diligently shall be on the Central Public Information Officer or the State Public Information Officer, as the case may be.

(2) Where the Central Information Commission or the State Information Commission, as the case may be, at the time of deciding any complaint or appeal is of the opinion that the Central Public Information Officer or the State Public Information Officer, as the case may be, has, without any reasonablecause and persistently, failed to receive an application for information or has not furnished information within the time specified under sub-section (1) of section 7 or malafidely denied the request for information or knowingly given incorrect, incomplete or misleading information or destroyed information which was the subject of the request or obstructed in any manner in furnishing the information, it shall recommend for disciplinary action against the Central Public Information Officer or the State Public Information Officer, as the case may be, under the service rules applicable to him.

छत्तीसगढ़ राज्य की आदर्श पुनर्वास नीति - 2007 (यथासंशोधित)
प्रस्तावना:-
1. प्राकृतिक संसाधनो से भरपूर छत्तीसगढ़ राज्य क्रमश: विकास की ओर अग्रसर हो रहा है। आर्थिक क्षेत्र के विभिन्न सेक्टरों में नयी विकास परियोजनाएं तथा विद्युत उत्पादन, सिंचाई, खनिज उत्पादन, राष्ट्रीय उद्यान एवं अभ्यारण्यों का विकास आदि, क्रियान्वित हो रही है और अनेको नई परियोजनाओं के लिये निजी भूमि के अर्जन की आवश्यकता होती है। बडी परियोजनाओं के लिये आबादी क्षेत्रों का पुनर्स्थापन भी आवश्यक होता है।
2. पूर्ववर्ती मध्यप्रदेश राज्य में कतिपय विभागीय पुनर्वास नीतियां तो प्रचलित थी किन्तु एक समग्र पुनर्वास नीति नहीं थी। वर्तमान में अलग-अलग सेक्टरों की परियोजनाओं के अन्तर्गत की जाने वाली पुनर्वास व्यवस्था में एकरूपता का अभाव है। अतएव एक समग्र आदर्श पुनर्वास नीति बनाने की आवश्यकता है।
3. छत्तीसगढ़ राज्य की यह आदर्श पुनर्वास नीति उपर्युक्त आवश्यकता की पूर्ति करेगी। इसके फलस्वरूप विकास परियोजनाओं से प्रभावित व्यक्तियों के सुविधाजनक पुनर्वास में तो मदद मिलेगी हीं समुचित पुर्नस्थापना होने से विकास परियोजनाओं के क्रियान्वयन को भी गति मिलेगी।

 

उद्देश्य एवं मार्गदर्शी सिद्धान्त:-
1.1 उद्देश्य:
पुनर्वास नीति का मुख्य उद्देश्य प्रदेश में क्रियान्वित की जाने वाली विभिन्न शासकीय तथा निजी संस्थानों की परियोजनाओं के लिए आवश्यक भूमि के अधिग्रहण से प्रभावित व्यक्तियों की अधिग्रहीत की जाने वाली भूमि का समुचित मुआवजा मिलने के साथ-साथ उनके रहने और रोजगार की ऐसी व्यवस्था हो सके जो भूमि अधिग्रहण के पूर्व की स्थिति के समकक्ष अथवा बेहतर हो। इस हेतु निम्नलिखित के संबंध में विशिष्ट प्रावधान किये गए हैः-
1.1.1 परियोजना से प्रभावित व्यक्तियों को उनकी अधिग्रहित भूमि तथा अन्य अचल संपत्ति के लिए वैकल्पित भूमि का आबंटन तथा/अथवा वाजिब मुआवजे का वितरण विस्थापन के पूर्व सुनिश्चित करना।
1.1.2 परियोजना से प्रभावित ऐसे परिवारों को जिनके आवासीय भवन अधिग्रहीत हो, नए स्थान पर सुनियोजित बसाहट स्थापित कर उनके रहने की ऐसी वैकल्पिक व्यवस्था करना जो मूल सुविधा के समक्ष अथवा बेहतर हो।
1.1.3 परियोजना से प्रभावित परिवारों को परियोजना में स्थाई रोजगार उपलब्ध कराने की व्यवस्था करना।
1.1.4 परियोजना से प्रभावित ऐसे भूमिहीन परिवारों, जो कृषि के भिन्न धन्धे/रोजगार के माध्यम से जीवन यापन करते हों के लिए यथासंभव उनके मूल धन्धे/ रोजगार की वैकल्पिक व्यवस्था करना।
1.1.5 यह सुनिश्चित करना कि किसी परियोजना के लिए आवश्यक भूमि का हीं अधिग्रहण किया जाए और यदि अधिग्रहीत भूूमि का उपयोग विहित प्रयोजन हेतु न हो तो जहां ऐसा करना विधि सम्मत हो, अधिग्रहित भूमि का मूल प्रयोजन या अन्य आवश्यक प्रयोजन के लिए उपयोग में लाया जा सके।
1.1.6 परियोजना से प्रभावित परिवारों/व्यक्तियों के पुनर्वास की व्यवस्था इस नीति के अनुरूप हो, यह सुनिश्चित करने के लिए पुनर्वास कार्यों के पर्यवेक्षण तथा मानिटरिंग की व्यवस्था करना।
1.2 मार्गदर्शी सिध्दान्त:-
उपर्युक्त उद्देश्य की प्राप्ति निम्नलिखित मार्गदर्शी सिध्दान्तों का पालन करते हुए की जाएगी:-
1.2.1 यह नीति इसके प्रकाशन के दिनांक से समस्त ऐसी परियोजनाओं पर लागू होगी जिनमें प्रकाशन के दिनांक तक भू-अर्जन की कार्यवाही अर्थात् अवार्ड पारित होने की कार्यवाही पूर्ण नहीं हुई हो।
1.2.2 पुनर्वास के प्रयोजनों के लिए राजस्व ग्राम तथा वन ग्राम में कोई अन्तर नहीं किया जाएगा।
1.2.3 विभाग/निजी संस्थानों द्वारा अधिग्रहित भूमि का उपयोग अधिग्रहण के लिए विनिर्दिष्ट प्रयोजनों अथवा सक्षम प्राधिकारी द्वारा अनुमोदित अन्य प्रयोजन के लिए एक निश्चित कालावधि के भीतर करना आवश्यक होगा। ऐसा न करने पर अधिग्रहित भूमि का उपयोग, जिन मामलों में ऐसा करना विधि सम्मत हो उसके मूल प्रयोजन अथवा राज्य शासन द्वारा निर्देशित किसी अन्य प्रयोजन के लिए किया जा सकेगा।
1.2.4 जिन मामलो में किसी परियोजना के लिए आबादी/आवासीय भूमि भी अधिग्रहित हो, उनके परियोजना के क्षेत्र समीप वैकल्पिक सुनियोजित बसाहट का प्रावधान पुनर्वास योजना में ही किया जाएगा। वैकल्पिक बसाहट में मूलभूत आवासीय, व्यवसायिक तथा वाणिज्यिक सुविधाएं निर्मित की जाएंगी, जो मूल बसाहट के समकक्ष या उससे बेहतर होगी।
1.2.5 पुनर्वास योजना में कमजोर वर्गो तथा अनुसूचित क्षेत्र में निवास करने वाले व्यक्तियों का विशेष ध्यान रखा जाएगा। इस हेतु व्यक्तियों जो भू-अर्जन अधिनियम की धारा-4 के तहत प्रकाशित अधिसूचना की तारीख के न्यूनतम तीन वर्ष पूर्व से शासकीय भूमि पर रह रहें हों अथवा अनुसूचित क्षेत्र में वर्ष 1990 के पूर्व से शासकीय भूमि पर कृषि कार्य कर रहे हों, को भी पुनर्वासित किया जाएगा।
1.2.6 परियोजना से प्रभावित व्यक्तियों के लिए स्थापना नई बसाहटों मे अधोसंरचना निर्माण/विकास कार्य कराने हेतु राज्य की सभी योजनाओं का लाभ प्राथमिकता पर उपलब्ध कराया जाएगा ताकि नई बसाहटों में मूलभूत तथा नागरिक सुविधाएं पहले से बेहतर बनाई जा सके।
1.2.7 वाणिज्यिक परियोजनाओं के लिए भू-अर्जन से प्रभावित ऐसे विस्थापित परिवारों, जिनकी 75 प्रतिशत से अधिक भूमि अर्जित हो, के लिए सदस्य को उसकी अर्हतानुसार परियोजना मे रोजगार उपलब्ध कराया जाएगा। औद्योगिक तथा खनन परियोजनाओं के लिए भू-अर्जन से प्रभावित प्रत्येक विस्थापित परिवार के एक सदस्य को उसकी अर्हतानुसार रोजगार की व्यवस्था की जाएगी।
1.2.8 परियोजना से प्रभावित परिवारों को उनकी मूल स्थिति से बेहतर स्थिति में लाने के लिए उपर्युक्त के अतिरिक्त शासन के हितग्राही मूलक योजनाओं, जिनमें स्वरोजगार की योजना भी शामिल होगी, का लाभ दिया जाएगा। योजनाओं का लाभ लेने के लिए आवश्यक प्रशिक्षण की व्यवस्था की जाएगी।
1.2.9 परियोजना के लिए भू-अधिग्रहण तथा पुनर्वास योजना के क्रियान्वयन की कार्यवाही साथ-साथ की जाएगी।
1.2.10 पुनर्वास योजना का समयबध्द क्रियान्वयन करने और प्रभावित व्यक्तियों को लाभ उपलब्ध कराने के सतत पर्यवेक्षण तथा मानिटरिंग की व्यवस्था हेतु राज्य स्तरीय तथा जिला स्तरीय समितियां गठित की जाएंगी।
2. परिभाषाएं:-
2.1 (क) ग्राम का साधारणतया निवासी व्यक्ति:- ग्राम के साधारणतया निवासी व्यक्ति से तात्पर्य ग्राम में रहते हुए कृषि कार्य (स्वयं की भूमि या अन्य की भूमि पर कृषि या मजदूरी) करने वाले या कारीगरी, शिल्पकारी या सेवा कार्य करने वाले से है।
(ख) प्रभावित व्यक्ति:- प्रभावित व्यक्ति से अभिप्राय ऐसे व्यक्ति से है जो उस क्षेत्र में, जिसकी परियोजना के लिये आवश्यकता है, भू-अर्जन की धारा 4 के अधीन अधिसूचना के प्रकाशन की तारीख से कम से कम तीन वर्ष पूर्व से साधारणतया रहता है तथा कोई व्यापार धंधा, या आजीविका के लिये कार्य करता रहा है या कम से कम तीन वर्ष पूर्व से निजी भूमि पर काश्त करता रहा है या कम से कम तीन वर्ष पूर्व से निजी भूमि पर काश्त करता रहा है।
(ग) प्रभावित परिवार:- प्रभावित परिवार में शामिल है कोई प्रभावित व्यक्ति, उसकी पत्नि या पति तथा नाबालिग बच्चे और प्रभावित व्यक्ति पर आश्रित वृद्ध माता-पिता, विधवा मॉ या बहन तथा अविवाहित पुत्री।
(घ) विस्थापित व्यक्तिः-विस्थापित व्यक्ति से तात्पर्य है कोई भूमि स्वामी, शासकीय पट्टेदार अथवा किसी सम्पत्ति का मालिक जो परियोजना के लिये उसकी भूमि के अर्जन के कारण जिसमें आबादी भू-खण्ड का अर्जन भी सम्मिलित है, ऐसी भूमि अथवा सम्पत्ति से विस्थापित हो गया हो।
(ङ) विस्थापित परिवार से तात्पर्य है कोई विस्थापित व्यक्ति, उसकी पत्नि तथा नाबालिग बच्चे और विस्थापित व्यक्ति पर आश्रित वृद्ध माता-पिता, विधवा मां या बहन तथा अविवाहित पुत्री।
स्पष्टीकरण:-
विस्थापित व्यक्ति के बालिग पुत्र को जो भू-अर्जन की धारा-4 के अन्तर्गत अधिसूचना प्रकाशित होने की तारीख से बालिग हो गया है, एक अलग परिवार के रूप में माना जाएगा।
(च) भूमिहीन कृषक:- भूमिहीन कृषक से तात्पर्य ऐसे कृषक से है जिसके परिवार के किसी सदस्य के नाम पर कोई कृषि भूमि न हो और वह किसी अन्य व्यक्ति के स्वमित्व की भूमि पर कृषि करता हो।
(छ) छोटा कृषक:- छोटा कृषक से तात्पर्य ऐसे किसान से है जो स्वयं की भूमि स्वामी स्वत्व की कुल एक हेक्टेयर तक असिंचित या 0.50 हेक्टेयर सिंचित भूमि धारण करता हो।
(ज) कृषि मजदूर:- कृषि मजदूर से तात्पर्य ऐसे व्यक्ति से है जिसकी अपनी कोई कृषि भूमि न हो और जो अन्य व्यक्ति की कृषि भूमि पर मजदूरी करता हो।
(झ) सेवाभूमि कोटवार:- सेवाभूमि कोटवार से वही तात्पर्य है जैसा कि छत्तीसगढ़ भू-राजस्व संहिता, 1959 में परिभाषित है।
(ञ) भूमिहीन परिवारः- भूमिहीन परिवार से तात्पर्य गैर कृषक विस्थापित परिवार से है।
3. भूमि मकान आदि का अधिग्रहण:-
3.1 भू-अर्जन अधिनियम के प्रयोजन के लिए लोक प्रयोजन के दायरे में उन परियोजनाओं को माना जाएगा जिन्हें राज्य सरकार इस हेतु मान्यता दे। इनमें अन्य परियोजनाओं के साथ-साथ पुनर्वास, रक्षा रेल, सड़क परिवहन, शिक्षा सिंचाई, बिजली उत्पादन, औद्योगिक उत्पादन, खनिज उत्पादन, जैसी परियोजनाएं शामिल होंगी।
3.2 परियोजनाओ का सामान्यत: निम्नलिखित दो श्रेणियों में विभक्त किया जाएगा:-
(1) ऐसी परियोजनाएं जिनमें प्रभावित व्यक्तियों की पुनर्बसाहट आवश्यक न हो।
(2) ऐसी परियोजनाएं जिनमें प्रभावित व्यक्तियों की पुनर्बसाहट आवश्यक हो।
3.3 परियोजनाओं के लिए आवश्यक निजी भूमि तथा वन भूमि प्रचलित अधिनियमों के प्रावधानों के अनुसार प्राप्त की आएगी। शासकीय राजस्व भूमि का हस्तांतरण /आबंटन राज्य शासन के तत्समय प्रभावशील स्थाई आदेशों /निर्देशों के अधीन किया जाएगा।
3.4 परियोजना के लिए आवश्यक भूमि अधिग्रहित करने के लिए राजस्व तथा वन भूमि में कोई विभेद नहीं किया जाएगा, किन्तु वनाच्छादिन/वृक्षारोपण वाली भूमि को यथासंभव अधिग्रहण से मुक्त रखने का प्रयास किया जाएगा।
3.5 किसी परियोजना के लिए भूमि तथा सम्पत्ति का अधिग्रहण करते समय इस नीति के अनुरूप विस्थापितों के पुनर्वास की योजना भी सक्षम प्राधिकारी को प्रस्तुत की जाएगी।
3.6 परियोजना के लिए भू-अर्जन का प्रस्ताव करने वाले विभाग/संस्थान द्वारा परियोजना से विस्थापित व्यक्तियों का इस नीति के अनुरूप पुनर्वास करने के लिए एक पुनर्वास योजना बनाई जाएगी और अनुमोदित पुनर्वास योजना के क्रियान्वयन हेतु परिशिष्ट-तीन के प्रारूप में विभाग/संस्थान तथा जिला कलेक्टर के मध्य एक मेमोरेन्डम आफ अन्डरस्टैंडिंग (एम.ओ.यू.) हस्तांक्षरित किया जाएगा।
3.7 अनुमोदित पुनर्वास योजना के प्रावधानों के अनुरूप पुनर्वास कार्य की मॉनिटंरिंग /निगरानी इस प्रयोजन हेतु गठित जिला स्तरीय तथा राज्य स्तरीय निगरानी समितियों द्वारा की जाएगी।
3.8 किसी परियोजना के लिए भू-अर्जन का प्रस्ताव प्राप्त होने पर विस्थापित व्यक्तियों को शीघ्रताशीघ्र विधि सम्मत मुआवजा तथा अन्य सुविधाएं देने के लिए परियोजना क्षेत्र से सभी संबंधित भू-अभिलेखों को एक कार्यक्रम बनाकर अद्यतन किया जाएगा।
3.9 शासकीय राजस्व भूमि तथा वन भूमि के अतिक्रमण को भी पुनर्वास के प्रयोजनों के लिए पात्र माना जाएगा, बशर्ते की उसका राज्य/केन्द्र सरकार द्वारा परियोजना की स्वीकृति देने की तारीख से कम से कम 3 वर्ष पूर्व से शासकीय भूमि पर सतत् अधिपत्य रहा हो।
3.10 ऐसे मामलों में जहां किसी व्यक्ति की 75 प्रतिशत भूमि अधिग्रहीत की गई हो, या किसी ग्राम का अन्त क्षेत्र पानी से घिर जाए वहां यदि प्रभावित व्यक्ति ऐसा चाहें तो संबंधित विभाग/परियोजना द्वारा ऐसे क्षेत्र की सम्पूर्ण अधिग्रहीत करने का प्रयास किया जाएगा।
3.11 विस्थापित होने वाले परिवारों को उनके निवास हेतु प्लाट या मकान दिया जाएगा जिसके लिये आवश्यक भूमि का चयन भू-अर्जन की योजना तैयार करते समय ही पुनर्वास योजनानुसार विस्थापित व्यक्तियों के पुनर्वास हेतु आवश्यक भूमि भी साथ-साथ अर्जित की जाएगी।
3.12 भूमिहीन व्यक्तियों को भी यथा संभव परियोजना क्षेत्र के आसपास ही बसाया जाएगा। ताकि वे परियोजना के क्षेत्र में विकास का लाभ अपने जीवन यापन हेतु कर सके।
3.13 परियोजना से विस्थापित परिवारों के लिए वैकल्पिक रोजगार की व्यवस्था कण्डिका-7 के प्रावधानों के अनुसार की जाएगी।
4. अधिग्रहित सम्पत्ति का मुआवजा:-
4.1 भूमि का मुआवजा:-
4.1.1 जिन विस्थापित काश्तकारों की भूमि अधिग्रहित की जाती है उन्हें:-
(क) राज्य शासन की परियोजनाओं के मामलों में शासकीय भूमि उपलब्ध होने पर निजी भूमि के बदले शासकीय भूमि उपलब्ध कराई जाएगी। ऐसा संभव न होने पर भूमि के बदले मुआवजा दिया जाएगा।
(ख) निजी संस्थानों की परियोजनाओं के मामले में अधिग्रहित निजी भूमि के लिये मुआवजा दिया जाएगा।
4.1.2 शासकीय अतिक्रमित भूमि के लिए कोई मुआवजा नहीं दिया जाएगा। किन्तु जिला स्तरीय समिति की अनुशंसा पर अनुसूचित क्षेत्रों में 1990 के पूर्व के अतिक्रामकों को भूमि आबंटित की जाएगी।
4.1.3 डूब से प्रभावित क्षेत्रों में भूमि की कीमते प्राय:दबी हुई रहती है। अतएव ऐसी परियोजनाओं के डूब क्षेत्र के लिए अर्जित की जाने वाली कृषि भूमि आबादी प्लाटों आदि का मुआवजा समीपवर्ती सिंचाई क्षेत्र (कमाण्ड) की भूमि के क्रय-विक्रय के आंकडों के आधार पर निर्धारित किया जाएगा।
4.1.4 नगरीय आबादी प्लाटों तथा अन्य नगरीय भूमि का मुआवजा डूब क्षेत्र के बाहर निकटवर्ती क्षेत्र में उसी क्षेत्र में नगरीय भूमि का औसत बिक्री दरों को आधार मानकर किया जाएगा।
4.1.5 सुदूर स्थित क्षेत्रों में और विशेष रूप से आदिवासी बाहुल्य क्षेत्रों में अधिग्रहीत किए जाने वाली भूमि के वास्तविक बाजार मूल्य के आंकलन के लिए भूमि के क्रय-विक्रय के पर्याप्त व वर्तमान कालावधि के आंकडे नहीं मिल पाते हैं। अतएव:-
(क) वाणिज्यिक तथा औद्योगिक परियोजनाओं के लिए भू-अर्जन के मामलों में भू-अर्जन अधिनियम के तहत निर्धारित मुआवजे के अतिरिक्त इतनी राशि और भूगतान की जाएगी कि भूमि स्वामी को प्राप्त होने वाली न्यूनतम कुल राशि पड़त भूमि हेतु रूपये 50,000/- प्रति एकड़, असिंचित (एक फसली) भूमि हेतु रूपये 75,000/-प्रति एकड़ एवं सिंचित (दो फसली) भूमि हेतु रूपये 1,00,000/- हो जाए।
(ख) शासकीय परियोजनाओं के लिये भू-अर्जन के मामलों में भू-अर्जन अधिनियम के तहत निर्धारित मुआवजे के अतिरिक्त इतनी राशि और भुगतान की जाएगी कि भूमि स्वामी को प्राप्त होने वाली न्यूनतम कुल राशि पड़त भमि हेतु रूपये 30,000/- प्रति एकड, असिंचित (एक फसली) भूमि हेतु रूपये 45,000/- प्रति एकड तथा सिंचित दो (फसली भूमि) हेतु रूपये 60,000/- प्रति एकड़ हो जाए। यदि शासकीय भूमि उपलब्ध हो तो शासकीय परियोजनाओं के विस्थापित भू-स्वामियों को भूमि के बदले भूमि का विकल्प भी उपलब्ध होगा।
(ग) यदि भू-अधिनियम की धारा-4 की धारा (1) के अनुसार अधिसूचना जारी होने के दिनांक को कलेक्टर द्वारा मुद्रांक शुल्क भुगतान के प्रयोजन के लिये निर्धारित की गई गाईड लाईन दर भू-अर्जन अधिनियम के अन्तर्गत परिगणित बाजार मूल्य से अधिक हो तो भू-धारक को देय न्यूनतम राशि की गणना धारा 4(1) की अधिसूचना के प्रकाशन के दिनांक को प्रचलित गाईड लाईन दर अथवा उपरोक्त (क) अथवा (ख) में से जो भी अधिक हो, उसके आधार पर की जाएगी।
4.1.6 कोटवार को सेवा भमि का मुआवजा देय नहीं होगा, किन्तु भूखंड आबंटन एवं अन्य सुविधाएं अन्य विस्थापितों की भांति प्राप्त करने की पात्रता होगी।
4.2 वृक्षों का मुआवजा:-
अधिग्रहित निजी भूमि पर स्थित फलदार वृक्षों का मूल्य उनसे प्राप्त होने वाली वार्षिक आय एवं लकडी के मूल्य आदि के आधार पर निर्धारित किया जाएगा। अन्य वृक्षों का मूल्य अर्जित भूमि पर स्थित वृक्षों की लकड़ी के आधार पर आंका जाएगा।
4.3 मकान एवं सम्पत्ति का मुआवजा:-
4.3.1 अन्य सम्पत्तियों जैसे मकान, कुआँ, निजी बाडी़, अन्य निर्माण जैसी सम्पत्ति का मूल्य उसे वैसी ही हालत में फिर से उपलब्ध कराने के लिये आवश्यक व्यय के बराबर आंका जाएगा।
4.3.2 अतिक्रमण विस्थापितों के मामले में केवल अतिक्रमित भूमि पर बने मकानों के लिए हीं मुआवजा दिया जाएगा। किन्तु अनुसूचित क्षेत्रों में जिला स्तरीय समिति की अनुशंसा पर वर्ष 1990 के पूर्व के अतिक्रामकों से प्राप्त की गई भूमि पर के अन्य निर्माण कार्यो के लिए भी मुआवजा दिया जाएगा।
5. विस्थापितों को कृषि भूमि आबंटन:-
5.1 राज्य शासन की परियोजनाओं के लिए भू-अर्जन से प्रभावित ऐसे विस्थापित परिवारों जिनके जोत की 50 प्रतिशत से अधिक भूमि अर्जित की जाती है को शासकीय भूमि उपलब्ध होने की स्थिति में परियोजना के क्षेत्र के आसपास शासकीय भूमि आबंटित करने का प्रयास किया जाएगा।
5.2 शासकीय परियोजनाओं के जिन मामलों में मुआवजें के बदले भूमि आबंटन किया जाएगा उनमें भूमि विकास के लिए रूपये 10,000/- (रूपये दस हजार) प्रति एकड़ की दर पर अतिरिक्त राशि का भुगतान किया जाएगा।
5.3 आबंटित भूमि में कुंआ, नलकूप या अन्य साधनों से सिंचाई के लिये विस्थापित परिवारों को शासन द्वारा विद्यमान योजनाओं के तहत सहायता दी जाएगी। यदि नई भूमि ऐसे स्थान पर स्थित है जहां सिंचाई सुविधा न होने के तथ्य को कृषि विभाग द्वारा प्रमाणित किया जाए वहां शासन की विद्यमान योजनाओं के तहत सहायता दी जाए।
5.4 कोटवार को सेवा भूमि का कोई मुआवजा देय नहीं होगा किन्तु भू-खण्ड आबंटन एवं अन्य सुविधाएं अन्य विस्थापितों की भांति प्राप्त करने की पात्रता होगी।

 

6. विस्थापितों को भू-खण्ड आबंटन:-
6.1 ग्रामिण क्षेत्रों में प्रत्येक विस्थापित परिवार को निम्नानुसार नि:शुल्क वैकल्पिक भू-खण्ड उपलब्ध कराया जाएगा:-
(1) भूमिहीन परिवार 300 वर्गमीटर
(2) लघु/सीमान्तक कृषक परिवार 450 वर्गमीटर
(3) अन्य कृषक परिवार 600 वर्गमीटर
6.2 नगरीय विस्थापित परिवारों का पुनर्वास नए नियोजित नगरीय क्षेत्रों में किया जाएगा। इस कार्य के पूर्व स्थानीय निकायों (नगर निगम, नगर पालिका परिषद, नगर पंचायत) से परामर्श लिया जाएगा। जहां आवश्यकता हो छ.ग. गृह निर्माण मण्डल अन्य एजेंन्सी से भू-खण्डों के विकास एवं भवनों के निर्माण के लिए विशेष योजनाएं हाथ में ली जाएंगी।
6.3 नगरीय क्षेत्रों के विस्थापित परिवारों के पुनर्वास के लिए निम्नलिखित आकारों के भूखण्ड बनाए जाएंगे:-
(1) कम आय वर्ग 95 वर्गमीटर
(2) अल्प आय वर्ग 140 वर्गमीटर
(3) मध्यम आय वर्ग 280 वर्गमीटर
(4) उच्च आय वर्ग 420 वर्गमीटर
6.4 किसी विस्थापित परिवार को आय के आधार पर उपर्युक्त विर्निदिष्ट न्यूनतम आकार के भूखण्ड अथवा उसके अर्जित किए गए भूखण्ड के आधार पर भूखण्ड की पात्रता होगी। इस अवधारणा के अन्तर्गत विस्थापित परिवार को उसके विद्यमान भूखण्ड के आकार से बडे आकार का वह भूखण्ड पाने की पात्रता होगी जो कि उपरोक्त 4 प्रकार के मानक भूखण्डों में आता हो। उदाहरणार्थ यदि किसी मध्यम आय वर्ग के व्यक्ति द्वारा धारित वर्तमान भूखण्ड का आकार 200 वर्गमीटर है जो उसे नये स्थान पर 280 वर्गमीटर भूखण्ड पाने की पात्रता होगी।
6.5 यदि कोई विस्थापित परिवार उपरोक्त पात्रता के अनुसार मिलने वाले आकार के भूखण्ड से बड़े आकार का भूखण्ड चाहे तो उपलब्धता के आधार पर अतिरिक्त मूल्य भुगतान कर प्राप्त कर सकेगा।
6.6 सभी वर्ग के भूखण्डों की मूल्य निर्धारित करने की प्रक्रिया एक समान होगी। मुल्य का निर्धारण वास्तविकता के आधार पर होगा। यदि नए भूखण्ड की दर विस्थापितों से अधिग्रहित भूखण्ड के मुआवजे की दर से अधिक हो तब अन्तर की राशि परियोजना द्वारा दी जाएगी।
6.7 नए स्थान में भूखण्ड आबंटन हेतु एक परिवार एक भूखण्ड का सिद्धांत अपनाया जाएगा।
6.8 नए भवन निर्माण हेतु हुडको एवं अन्य संस्थाओं से ऋण उपलब्ध कराने हेतु प्रयास किया जाएगा।
6.9 जिन विस्थापित परिवारों के वाणिज्यिक/व्यवसायिक भवन अधिग्रहित हो उन्हें परियोजना द्वारा विस्थापितों के लिये नई बसाहटों में आवश्यकतानुसार वाणिज्यिक/व्यवसायिक भूखण्ड विकसित कर कोई लाभ नहीं, हानि नहीं के आधार पर उपलब्ध कराए जाएंगे।
6.10 यथा संभव नव स्थापित आदर्श ग्राम एवं नगरों का नाम पुराने ग्राम एवं नगरों के नम पर हीं किया जाएगा ताकि भावनाओं को बनाए रखा जा सके। नाम के आगे केवल नया (न्यू) शब्द जुड जाएगा, जैसे रामनगर में न्यू रामनगर।
7. रोजगार तथा अन्य सुविधाएं:-
7.1 रोजगार की पात्रता ऐसे प्रत्येक विस्थापित परिवार को होगी जो भू-अर्जन अधिनियम की धारा 4 (1) की अधिसूचना के प्रकाशन की तारीख के तीन वर्ष पूर्व से स्वतंत्र रूप से या संयुक्त परिवार के रूप मे अधिगृहित भूमि के भूमि स्वामी या पट्टेदार रहे हों। वाणिज्यिक परियोजनाओं के लिए भू-अर्जन से प्रभावित ऐसे विस्थापित परिवारों जिनकी 75 प्रतिशत से अधिक भूमि अर्जित हो, के एक सदस्य को तथा औद्योगिक/खनन परियोजनाओं के लिए भू-अर्जन से प्रभावित प्रत्येक विस्थापित परिवार के एक सदस्य को उनकी अर्हता तथा उपर्युक्तता के अनुसार परियोजना का क्रियान्वयन करने वाली एजेन्सी/संस्थान द्वारा रोजगार की व्यवस्था की जाएगी।
(अ) परियोजना के कार्यो में रोजगार देते समय परियोजना विस्थापित परिवारों को प्राथमिकता दी जाएगी।
(ब) परियोजना मे पात्र शिक्षित नवयुवकों को बेहतर रोजगार के लिए उनकी शैक्षणिक योग्यता के अनुसार प्रशिक्षण की व्यवस्था की जाएगी।
(स) शासकीय विभाग/सार्वजनिक उपक्रम की परियोजना के लिए भू-अर्जन से विस्थापित ऐसे व्यक्तियों जिन्हें रोजगार की पात्रता हो, की श्रेणी-3 के पदों पर नियुक्ति हेतु आयु सीमा में 2 वर्ष की छूट दी जाएगी।
(द) परियोजना से विस्थापित परिवारों को लाभजनक कार्य उपलब्ध कराने के लिये आवश्यक प्रशिक्षण देने के लिए विशेष व्यवस्था की जाएगी।
(इ) डूब से प्रभावित क्षेत्रों के मछुआरों को प्रशिक्षण देने की व्यवस्था की जाएगी। यदि परियोजना में मछली पालन के अवसर हों तो डूब से प्रभावित व्यक्तियों की समिति को मछली पालन के ठेके में प्राथमिकता दी जाएगी।
(फ) औद्योगिक/खनन परियोजना के विस्थापित परिवारों को रोजगार की व्यवस्था निम्नलिखित प्राथमिकता क्रम में दी जाएगी:-
(i) जिनकी शत प्रतिशत कृषि भूमि तथा घर अधिग्रहीत हुए हों,
(ii) जिनकी शत प्रतिशत कृषि भूमि अधिग्रहीत हुई हों, जिनकी 75 प्रतिशत से अधिक कृषि भूमि अधिग्रहीत हुई हों,
(iii) जिनकी 50 प्रतिशत से अधिक कृषि भूमि अधिग्रहीत हुई हों,
(iv) जिनकी 25 प्रतिशत से अधिक कृषि भूमि अधिग्रहीत हुई हों,
(v) अन्य विस्थपित परिवार।
(ज) यदि वाणिज्यिक/औद्योगिक/खनन परियोजना तथा उससे संबद्ध कार्य कलापों में नियमित रोजगार के अवसर रोजगार के लिये पात्र विस्थापित परिवारों की संख्या कम हों तो उन्हें निम्नलिखित विकल्प उपलब्ध होंगेः-
(1) विस्थापित परिवारों के एक सदस्य को मुआवजे के अतिरिक्त परियोजना क्षेत्र अथवा परियोजना क्षेत्र से लगी हुई अथवा निकटस्थ विकासखण्ड मुख्यालय अथवा नगर पंचायत/नगर पालिका क्षेत्र में (उसकी इच्छानुसार) पक्की दुकान निर्मित करके दी जाएगी जिसका सम्पूर्ण व्यय कम्पनी द्वारा वहन किया जाएगा। जनपद पंचायत मुख्यालय/नगर पंचायत मुख्यालय/नगर पालिका क्षेत्र में कम्पनी को कलेक्टर द्वारा बिक्री की दरों के आधार पर भूमि आबंटित की जाएगी जिस पर कम्पनी द्वारा पक्की दुकानों का निर्माण किया जाकर विस्थापितों को आबंटित किया जाएगा।
(2) जो विस्थापित परिवार वैकल्पिक रोजगार के लिए परियोजना में उपयोग होने वाले कच्चे माल या परियोजना के उत्पाद की ढुलाई से संबंधित परिवहन व्यवसाय या यात्री परिवहन में स्वरोजगार हेतु विकल्प दें, उन्हें परियोजना से संबंधित परिवहन ठेकों में संस्थान द्वारा प्राथमिकता दी जाएगी तथा इस हेतु परिवहन यान उपलब्ध कराने में सहायता दी जाएगी।
7.2 विस्थापित परिवारों के ऐसे सदस्यों को, जिन्हें परियोजना में रोजगार प्राप्त करने की पात्रता हो किन्तु वे आवश्यक तकनीकी अर्हता नहीं रखते हों उन्हें उनकी शैक्षणिक योग्यतानुसार आवश्यक प्रशिक्षण देने की व्यवस्था वृहद परियोजनाओं के मामलों में संबंधित संस्थान द्वारा तथा अन्य मामलों में संबंधित शासकीय विभाग/संस्थान द्वारा की जाएगी। प्रशिक्षण की व्यवस्था राज्य शासन की उपलब्ध प्रशिक्षण सुविधाओं का उपयोग करते हुए अथवा स्वतंत्र रूप से, जहां जैसा संभव हो, की जाएगी।
7.3 परियोजना से प्रभावित अन्य व्यक्तियों, विशेषकर भूमिहीन व्यक्तियों, को शासन के संबंधिन विभागों द्वारा नए कौशल बढ़ाने हेतु प्रशिक्षण दिया जाएगा तथा छोटे कार्यों में रोजगार उपलब्ध कराने के प्रयास किये जाएंगे। परियोजना से उत्पन्न होने वाले रोजगार के अवसरों में ऐसे व्यक्तियों को कार्य दिया जाएगा।
7.4 विस्थापित परिवारों को राज्य शासन द्वारा क्रियान्वित की जाने वाली स्वरोजगार मूलक योजनाओं (डेयरी विकास, मुर्गीपालन, मतस्य पालन, लघु कुटीर उद्योग आदि) के लिए चिन्हित कर उन्हें वित्तीय संस्थाओं से ऋण की व्यवस्था करते हुए लाभान्वित करने के प्रयास किये जाएंगे।
7.5 शासकीय परियोजनाएं जैसे सिंचाई परियोजनाएं, सडक परियोजनाएं, स्कूल परियोजनाएं अथवा अस्पताल की परियोजनाएं जनकल्याणकारी होती है। उनमें रोजगार के अवसर प्राय: नहीं होतें हैं, इसलिये शासकीय परियोजनाओं के विस्थापित व्यक्तियों को रोजगार देने की आवश्यकता नहीं होगी परन्तु उन्हें शासकीय/अर्द्धशासकीय संस्थाओं में रोजगार देने मे प्राथमिकता देने के विधि सम्मत प्रावधान किये जाएंगे।
7.6 परियोजना के क्षेत्र में कार्यरत स्वसहायता समूहों को उद्योग स्थापना से निर्मित होने वाले कार्यकलापों/गतिविधियों में जोड़ने के लिए पहल की जाएगी। इस हेतु संबंधित विभाग/संस्थान द्वारा कार्यशालाओं का आयोजन/प्रशिक्षण व्यवस्था के लिये कदम उठाए जाएंगे।
8. विस्थापितों को विविध सहायता:-
8.1 पुनर्स्थापित किये जाने वाले प्रत्येक विस्थापित परिवार को रूपये 11,000/- (रूपये ग्यारह हजार) की एकमुश्त सहायता राशि पुनर्स्थापन अनुदान के रूप में दी जाएगी जिसे समय-समय पर बढ़ाया जा सकेगा।
8.2 पुनर्स्थापना योजना अनुसार विस्थापित परिवारों तथा उनके मवेशियों को अधिग्रहित क्षेत्र से नई जगह ले जाने का कार्य जिला प्रशासन की देख-रेख में सम्पादित किया जाएगा। जिस पर होने वाले व्यय का वहन परियोजना द्वारा किया जाएगा। यदि विस्थापित परिवार परियोजना द्वारा की गई पविहन व्यवस्था का लाभ प्राप्त नहीं करता है तो उसे रूपये 1,000/- (रूपये एक हजार) की राशि का एक मुश्त अनुदान दिया जाएगा, जिसे समय-समय पर बढ़ाया जा सकेगा।
8.3 ग्रामीण क्षेत्रों में विस्थापितो के लिए नई बसाहट के क्षेत्र में सार्वजनिक मूलभूत सुविधाए उपलब्ध कराने के लिये राज्य शासन की सुसंगत योजनाओं के तहत प्राथमिकता पर धनराशि उपलब्ध कराई जाएगी।
8.4 नगरीय क्षेत्रों के ऐसे विस्थापित जो मूल स्थान पर अपना व्यवसाय/व्यापार किराए के भवन में कर रहें हों को नई नगरीय बसाहटों में बनी दुकानों को किराए पर देने में प्राथमिकता दी जाएगी। ग्रामीण क्षेत्रों में ऐसे विस्थापित व्यक्ति जो व्यवसायिक भूखण्ड पाने के इच्छुक हों उन्हें निर्धारित शर्तो पर उचित भू-खण्ड/दुकान उपलब्ध करानें में प्राथमिकता दी जाएगी।
8.5 जो व्यक्ति मात्र कब्जेदार है उसे पुनर्बसाहट की स्थिति में नई बसाहट में आबादी जमीन दी जाएगी और साथ में पुनर्वास अनुदान भी दिया जाएगा। बशर्ते वह धारा-4 की अधिसूचना के प्रकाशन से कम से कम तीन वर्ष पूर्व से या वैध किराएदार के रूप में न्यनतम एक वर्ष पूर्व से रह रहा हो।
8.6 विस्थापित परिवारों में से यदि कोई स्वरोजगार हेतु उद्योग स्थापित करना चाहे तो उन्हें निकटस्थ औद्योगिक क्षेत्र में भू-आबंटन में प्राथमिकता दी जाएगी।
8.7 प्रभावित क्षेत्रों के समीप क्रियान्वित की जाने वाली योजनाओं में वाणिज्यिक भू-खण्ड दुकानें इत्यादि के आबंटन में प्रभावित परिवारों को समुचित प्राथमिकता दी जाएगी।
8.8 विभिन्न गतिविधियों के लिये पुनर्बसाहट हेतु स्थापित नये नगरीय क्षेत्रों को नियोजन करते समय अनौपचारिक मांग, प्रकार, सुविधा, उपयोगिता, दूरी एवं आवागमन के साधनों आदि पर यथोचित ध्यान दिया जाएगा।
8.9 डूब/विस्थापित क्षेत्रों में स्थित धार्मिक स्थल जैसे मंदिर, मस्जिद, गुरूद्वारा, चर्च पुरातत्व महत्व के स्थल आदि के एवज में नये क्षेत्रों में उनके नवनिर्माण तथा कब्रगाह व दाह संस्कार हेतु स्थल के लिये आवश्यक प्रावधान रखा जाएगा।
8.10 परियोजना के विस्थापित परिवारों को परियोजना के अस्पताल में चिकित्सा सुविधा तथा उनके बच्चों को परियोजना के स्कूल में प्रवेश की सुविधा नामिनल/रियायती शुल्क पर उपलब्ध कराई जाएगी।
8.11 अनुसूचित क्षेत्रों में जीवन निर्वाही अर्थव्यवस्था बनी हुई है। विकास के दीर्घकालीन आयोजन में इस बात पर विशेष रूप से ध्यान दिया जाएगा कि खाद्यान्न की आत्मनिर्भरता बनी रहें।
8.12 अनुसूचित जाति एवं अनुसूचित जन जाति के विस्थापित परिवारों को जो सुविधाएं फिलहाल अनुसूचित जाति एवं जनजाति विकास विभाग के कार्यक्रमों के अन्तर्गत मिल रही है, उन्हें नई जगह पर यथावत रखा जाएगा।
9. सलाहकार समितियॉ:-
9.1 परियोजनाओं के लिये भूमि अधिग्रहण से प्रभावित व्यक्तियों के पुनर्स्थापना की पुनर्वास योजना का अनुमोदन संबंधित प्रशासकीय विभाग द्वारा भू-अर्जन के लिए अनुमति देते समय किया जाएगा।
9.2 विकास परियोजनाओं से प्रभावित व्यक्तियों के पुनर्स्थापना की पुनर्वास योजनाओं का पर्यवेक्षण एवं मानिटरिंग निम्नलिखित समितियों द्वारा की जाएगी।
9.2.1 ऐसी परियोजनाएं, जिनकी लागत 100 करोड़ से अधिक हो का राज्य स्तरीय पुनर्वास समिति द्वारा
9.2.2 ऐसी परियोजनाएं जिनकी लागत 100 करोड़ से कम हो, का जिला स्तरीय पुनर्वास समिति द्वारा।
9.3 राज्य स्तरीय तथा जिला स्तरीय पुनर्वास समितियों का गठन परिशिष्ट-एक अनुसार किया जाएगा।
10. पुनर्वास योजना की रूपरेखा अनुमोदन की प्रक्रिया आदि:-
10.1 शासकीय परियोजनाओं के मामलों में संबंधित विभागाध्यक्ष सार्वजनिक उपक्रमों की परियोजनाओं के मामले में संबंधित उपक्रम तथा निजी संस्थानों की परियोजनाओं के मामले मे संबंधित संस्थान द्वारा परियोजना के लिय भू-अर्जन से विस्थापित परिवारों के पुनर्वास हेतु एक ''पुनर्वास योजना'' तैयार की जाएगी जिसमें अन्य बातों के साथ-साथ परिशिष्ट-दो में उल्लेखित विवरण होंगे। पुनर्वास योजना तैयार करने के लिये अर्जित की जाने वाली भूमि उसके भूमिस्वमियों/पट्टेदारों भू-अर्जन से प्रभावित परिवारों तथा अन्य आवश्यक विवरण एकत्रित करने के लिये संबंधित विभाग/संस्थान द्वारा अनुरोध किये जाने पर जिला कलेक्टर द्वारा सहयोग/सहायता दी जाएगी।
10.2 यथास्थिति विभागाध्यक्ष, सार्वजनिक उपक्रम या निजी संस्थान पुनर्वास योजना सहित अपना भू-अर्जन प्रस्ताव औद्योगिक परियोजनाओं के मामलों में राज्य निवेश प्रोत्साहन बोर्ड/जिला निवेश प्रोत्साहन समिति के कार्यालय में तथा अन्य परियोजनाओं के मामलों में राज्य शासन के संबंधित प्रशासकीय विभाग/जिला कलेक्टर को प्रस्तुत करेगा।
10.3 राज्य शासन का संबंधित प्रशासकीय विभाग पुनर्वास योजना का परीक्षण करेगा और यह देखेगा कि पुनर्वास योजना आदर्श पुनर्वास नीति के अनुरूप तैयार की गई है और उसमें आवश्यक आर्थिक तथा सामाजिक पहलुओं का समावेश किया गया है। पुनर्वास योजना के अनुरूप बनाने के लिये उसमें प्रशासकीय विभाग उसे आदर्श पुनर्वास नीति के अनुरूप बनाने के लिये उसमें विभागाध्यक्ष/सार्वजनिक उपक्रम/निजी संस्थान से आवश्यक संशोधन कराएगा और उसे संबंधित जिले के कलेक्टर को भेजेगा।
10.4 ऐसे मामलों जिनमें भूमि अधिग्रहण के कारण आबादी की पुनर्बसाहट आवश्यक हो, उनमें प्रशासकीय विभाग से प्राप्त पुनर्वास योजना जिला कलेक्टर द्वारा संबंधित स्थानीय संस्था (ग्राम पंचायत, नगर पंचायत, नगरपालिका परिषद, नगर निगम) को निम्नानुसार उपलब्ध कराई जाएगी जो उसे सर्वसाधारण की जानकारी के लिए प्रकाशित करेंगें:-
(i) अनुसूचित क्षेत्रों के मामले में पंचायत विशेष उपबन्ध (अनुसूचित क्षेत्रों मे विस्तार) अधिनियम के प्रावधानों के तहत ग्राम सभाओं के परामर्श के समय।
(ii) गैर अनुसूचित क्षेत्रों में भू-अर्जन अधिनियम की धारा-4 के अन्तर्गत अधिसूचना के प्रकाशन के समय।
10.5 उपर्युक्त पैरा 10.4 की अपेक्षानुसार पुनर्वास योजना का प्रकाशन होने पर प्रभावित व्यक्ति संबंधित जिले के कलेक्टर को सुझाव दे सकेंगे। जिला कलेक्टर द्वारा प्राप्त सुझावों का आदर्श पुनर्वास नीति के प्रावधानों के परिपेक्ष्य में परीक्षण किया जाएगा और जिला स्तरीय समिति के समक्ष रखकर समिति के सुझाव प्राप्त किये जाएंगे।
10.6 उपर्युक्त पैरा 10.5 के तहत प्रभावित व्यक्तियों से प्राप्त सुझावों के संबंध में जिला पुनर्वास समिति के अभिमत सहित जिला कलेक्टर पुनर्वास योजना को संबंधित प्रशासकीय विभाग को भेजेगा। सार्वजनिक उपक्रम/निजी संस्थान की परियोजनाओं के मामलों में जिला कलेक्टर द्वारा राज्य शासन को भेजे गए अभिमत की एक प्रति सार्वजनिक उपक्रम/निजी संस्थान को भी उपलब्ध कराई जाएगी।
10.7 प्रभावित व्यक्तियों के सुझावों तथा उन पर जिला स्तरीय समिति के अभिमत पर विचारोपरान्त संबंधित प्रशासकीय विभाग शासकीय परियोजना के मामले मे स्वयं तथा सार्वजनिक उपक्रम एवं निजी संस्थान की परियोजना के मामले में यथास्थिति सार्वजनिक उपक्रम या निजी संस्थान से पुनर्वास योजना में समुचित संशोधन करने/कराने के उपरान्त उसका अनुमोदन करेगा तथा अनुमोदित पुनर्वास योजना की प्रतियॉ संबंधित जिला कलेक्टर तथा विभागाध्यक्ष/सार्वजनिक उपक्रम/निजी संस्थान को भेजेगा।
10.8 अनुमोदित पुनर्वास योजना प्राप्त होने पर कलेक्टर भू-अर्जन अधिनियम के अन्तर्गत अग्रिम कार्यवहियां करने के लिए अग्रसर होगा और भू-अर्जन अधिनियम/नियमों का पालन करते हुए भू-अर्जन सम्पन्न करेगा।
10.9 भू-अर्जन की कार्यवाही के प्रचलन के दौरान प्रभावित ग्राम/ग्रामों के निवासियों अथवा उनके संगठनों द्वारा परियोजना के संबंध में जानकारी चाहे जाने पर उन्हें चाही गई जानकारी जिला कलेक्टर के माध्यम से उपलब्ध कराई जाएगी। यदि किसी कारण से कोई जानकारी उपलब्ध नहीं कराई जा सकती हो तो आवेदक को उसका कारण संसूचित किया जाएगा।
10.10 राज्य अथवा संघ के किसी कानून के अन्तर्गत लोक प्रयोजन के लिए किसी भूमि के आवश्यक होंने संबंधी घोषणा तथा भू-अर्जन अधिनियम के अन्तर्गत जारी की जाने वाली विभिन्न अधिसूचनाओं/सूचनाओं का प्रकाशन विधि में विहीत स्थानों के अतिरिक्त स्थानीय निकायों/ग्राम पंचायतों के सूचना पटल पर भी किया जाएगा।
10.11 जिन मामलों में आबादी भूमि प्रभावित होती हो और पुनर्बसाहट आवश्यक हो, पुनर्बसाहट की योजना उन परिवारों जिनकी पुनर्बसाहट की जानी हो, से परामर्श करके तैयार की जाएगी। पुनर्बसाहट योजना के क्रियान्वयन का कार्यक्रम उस प्रकार निर्धारित किया जाएगा कि प्रभावित परिवार आबादी के अधिग्रहण के पूर्व नई बसाहट में पुनर्वासित हो जाए।
10.12 पुनर्वास योजना से संबंधित विवादो तथा हितकारी व्यक्ति की पहचान, उन्हें मिलने वाले फायदे आदि का निराकरण यथासंभव जिला स्तरीय समिति द्वारा किया जाएगा। जिला स्तरीय समिति राज्य स्तरीय समिति से मार्गदर्शन प्राप्त कर सकेगी।
10.13 बार-बार विस्थापन नहीं किया जाएगा और यदि अपवाद स्वरूप ऐसा करना आवश्यक हो तो ऐसा करने के लिए राज्य स्तरीय समिति का अनुमोदन प्राप्त किया जाएगा।
11. कतिपय परियोजनाओं के लिए विशिष्ट प्रावधान :-
विभिन्न परियोजनाओं की विशिष्ट स्थितियों को ध्यान में रखते हुए उपर बताए गए सिध्दान्तों और कार्यवाहियों के दायरे को प्रभावित किये बिना, कुछ विशिष्ट श्रेणियों की परियोजनाओं और उनकी प्रक्रियाओं के संबंध में निम्नलिखित दिशा निर्देशों का भी पालन किया जाएगा:-
11.1 सिंचाई/पनबिजली परियोजनाएं:-
11.1.1 जहां संभव होगा वहां जलाशय और उससे लगे हुए क्षेत्र के सघन विकास की योजना बनाई जाएगी, जिसमें उद्वहन सिंचाई के आधार पर कृषि और वृक्ष कृषि, मतस्य आखेट कार्यक्रमों का समावेश कर उस अंचल की धारण क्षमता में वृध्दि की जाएगी।
11.1.2 जलाशयों में पानी घटने पर उनसे निकलने वाली जमीन का अस्थायी आबंटन अपनी जमीन खोने वाले प्रभावित व्यक्ति को व्यक्तिगत खेती के लिये प्राथमिकता पर किया जाएगा प्रभावित व्यक्तियों की सहकारी समिति को मत्स्याखेट के मामले में प्राथमिकता व उचित रियायत दी जाएगी।
11.1.3 परियोजना निर्मित होने पर डूब क्षेत्र की ऐसी भूमि, जो वर्षा के बाद स्वत: खाली हो जाती है विस्थापित व्यक्तियों को कृषि कार्य हेतु पट्टे पर आबंटित की जाएगी।
11.1.4 यदि डूब क्षेत्र के लोगों को दी जा रही भूमि में उस सिंचाई परियोजना की नहरों से सिंचाई नहीं की जा सकती है तो उनकी भूमि की सिंचाई के लिये पृथक से योजना तैयार कर सिंचाई व्यवस्था की जाएगी।
11.2 औद्योगिक/खनिज परियोजनाएं :-
11.2.1 वृहद औद्योगिक, विद्युत उत्पादन और उत्खनन परियोजनाओं के मामले में संबंधित परियोजना के प्रभावित क्षेत्र को रेखांकित किया जाएगा। परियोजना के प्रस्तावक संस्थान के लिये यह जरूरी होगा कि वे स्थानीय आवश्यकतानुसार परियोजना के प्रभाव क्षेत्र के विकास के लिये योजनाएं बनाकर क्रियान्वयन करें। इस हेतु संबंधित संस्थान तथा राज्य शासन के प्रशासकीय विभाग के मध्य परियोजना तथा परियोजना क्षेत्र की विशेष परिस्थितियों को ध्यान में रखते हुए हुई सहमति अनुसार प्रतिवर्ष संस्थान के शुध्द लाभ का निर्धारित प्रतिशत, जो आवश्यकतानुयार एक प्रतिशत से तीन प्रतिशत होगा, आबंटित/व्यय किया जाएगा।
11.2.2 परियोजना से प्रभावित कृषकों के मामले में अनियमित, आकस्मिक रोजगार या मजदूरी के रूप में काम के अवसरों को जिन्दगी बसर करने का वैकल्पिक आधार अथवा रोजगार नहीं माना जाएगा। परियोजना के नियमित पदो में राज्य की औद्योगिक नीति में राज्य के अर्हताप्राप्त निवासियों को रोजगार उपलब्ध कराने संबंधी प्रावधानों के अनुपालन हेतु निम्नानुसार प्राथमिकताएं रखी जाएंगी:-
(i) परियोजना से प्रभावित व्यक्ति,
(ii) परियोजना के प्रभाव क्षेत्र के निवासी अन्य व्यक्ति,
(iii) राज्य में निवास करने वाले अन्य व्यक्ति।
11.2.3 औद्योगिक तथा खानन परियोजना का क्रियान्वयन करने वले संस्थान द्वारा निजी भूमि का कब्जा लेने के 2 वर्ष की कालावधि के भीतर (पहले परियोजना के निर्माण मे तथा परियोजना के चालू हो जाने के बाद परियोजना मे) रोजगार उपलब्ध नहीं कराया जाता है, तो संस्थान द्वारा रोजगार के लिए पात्र प्रत्येक परिवार के एक व्यक्ति को अर्हता के अनुरूप दिये जाने वाले रोजगार से प्राप्त होने वाली राशि के समतुल्य राशि, या रोजगार गारंटी योजना के तहत देय राशि, जो भी अधिक हो, बगैर काम के तब तक भुगतान की जाएगी, जब तक कि नियमित रोजगार की व्यवस्था न हो जाए।
11.2.4 उपजाऊ मिट्टी एल्यूवियल सोयल रेत जैसे लघु खनिज बाहुल्य क्षेत्रों में तो कृषि एवं प्लान्टेशन के माध्यम से वहां के रहवासियों को आय के बहुत अच्छे स्त्रोत उपलब्ध है और ऐसे क्षेत्र आर्थिक विकास में बहुत आगे है। किन्तु कोयला और आयरन जैसे मुख्य खनिज धारित क्षेत्रों के खनन कार्य से स्थानीय रहवासियों और विशेष रूप से अनुसूचित क्षेत्रों के रहवासियों को खनिज की उत्पादन योजनाओं से बहुत कम लाभ मिल पाया है। कोयल और आयरन और खानें राज्य के अत्यन्त गरीब और पिछडे अनुसूचित जनजाति बाहुल्य क्षेत्रों में स्थित है। अतएव गैर केप्टिव नई खनन परियोजनाओं के लिये भू-अर्जन/पुनर्स्थापन प्रस्तावों के साथ प्रस्तुत की जाने वाली पुनर्वास योजनाओं में यह प्रावधान अनिवार्यत: रखा जाएगा कि नई परियोजना से प्राप्त होने वाले खनिज का आवश्यकतानुसार एक पूर्व निर्धारित प्रतिशत अनुसूचित क्षेत्रों की औद्योगिक इकाईयों की कच्चे माल के आवश्यकता की पूर्ति हेतु उन्हें उपलब्ध कराया जाएगा।
11.2.5 यह सुनिश्चित किया जाऐगा कि लीज समाप्त होने के पश्चात् माईन क्लोजर प्लान के अनुसार खान क्षेत्र की भमि को यथासंभव उसकी मूल स्थिति में वापस लाया जाए। इस कार्य के लिए खनन कम्पनी अपनी आय का समुचित हिस्सा एक पृथक रिजर्व फन्ड (रेस्टोरेशन फन्ड) के रूप मे रखे।
11.2.6 चूंकि कोयला और लौह अयस्क का अधिकांश खनन कार्य भारत सरकार के उपक्रमों द्वारा किया जाता है, भारत सरकार से अनुरोध किया जाएगा कि वे सार्वजनिक क्षेत्र के खनन कम्पनियों को राज्य की पुनर्वास नीति का पालन करने के लिए कहें और आवश्यक होने पर इस हेतु केन्द्रिय कानूनों में आवश्यक संशोधन करें। पुनर्वास नीति के प्रावधानों का पालन सुनिश्चित करने हेतु आवश्यक होने पर संविधान की अनुसूची 5 द्वारा प्रदत्त शक्तियों के अन्तर्गत राज्य के रेगुलेशन्स बनाए जा सकेगें।
11.3 अभ्यारण्य तथा राष्ट्रीय उद्यान परियोजना :-
11.3.1 अभयारण्यों और राष्ट्रीय उद्यानों के प्रबन्धन सहित वन संसाधनों के विकास और उपयोग के नियोजन में उन पर स्थानीय समाज की निर्भरता को खासतौर से आदिवासी समाज के उनसे परस्पर पोषक संबंधों को आधारभूत माना जाएगा। इस मामले में संबंधिन नागरिकों और उनकी अर्थव्यवस्था के बारे में तथ्यों का लिखित रूप से उपलब्ध होना या न होना उसकी औपचारिक मान्यता होना या न होनाउससे संबंधित अद्यतन कानूनी स्थिति से किसी तरह की विसंगति इत्यादि का कोई असर नहीं होगा।
11.3.2 इन परियोजनाओ में विस्थापितों की परंपराओं के अनुरूप सभी के लिये समुचित जीवन यापन के लिये पूरी व्यवस्था और पूरे वर्ष के कामकाज के लिये योग्य सभी व्यक्तियों के लिये एक विशेष रोजगार योजना बनाई जाएगी। विस्थापन योजना का यह उद्देश्य होगा कि वन में रहने वले सभी नागरिकों के लिये वन संसाधन राष्ट्रीय उद्देश्य को ध्यान में रखते हुए तथा उसके पर्यावरणीय आकार को नुकसान पहुंचाए बिना बेहतर जीवन यापन की उनकी आकांक्षा पूरी करने में सक्षम आधार बनाया जा सकें।
12. विविध:-
12.1 भू-अर्जन के मामले निर्णित करनें हेतु विशेष न्यायालय स्थापित किये जाएंगे।
12.2 किसी शासकीय परियोजना के लिये भू-अर्जन/ हस्तांतरण द्वारा प्राप्त ऐसी सभी भूमि जो अधिग्रहण के बाद 10 वर्ष तक उपयोग मे नहीं लाई जाती है, वह भूमि राजस्व विभाग को स्वमेव वापस हो जाएगी और राजस्व विभाग राजस्व पुस्तक परिपत्र के प्रावधानों के अनुसार उसका अन्य प्रयोजन के लिए आबंटन या हस्तांतरण कर सकेगा।
12.3 पुनर्वास योजना से संबंधित समस्त खर्चों का वहन परियोजना का क्रियान्वयन करने वाले शासकीय विभाग या निजी संस्थान, जैसी भी स्थिति हों, द्वारा परियोजना में शामिल करते हुए वहन किया जाएगा।
12.4 राजधानी परियोजना क्षेत्र की पुनर्वास योजना पृथक से बनाई जाएगी।

राज्य स्तरीय एवं जिला स्तरीय पुनर्वास समितियां निम्नानुसार गठित की जाएंगी :-

परिशिष्ट दो
पुनर्वास योजना में पुनर्वास नीति को किसी भी प्रकार प्रभावित किये बिना अन्य बातों के साथ-साथ निम्नलिखित का समावेश किया जाएगा:-
1. सामान्य :- सभी पुनर्वास योजनाओं के लिए:-
1.1 परियोजना के उद्देश्य, बुनियादी मान्यताएं और कारक क्रियान्वयन की कालावधि का उल्लेख करते हुए विकास परियोजना की संक्षिप्त रूप रेखा,
1.2 परियोजना क्षेत्र का रेखांकन और उसके प्रभाव क्षेत्र का विवरण,
1.3 परियोजना के प्रत्येक तथा परोक्ष लाभों का विवरण,
1.4 भू-अभिलेखों के अनुसार परियोजना के लिए आवश्यक भूमि का क्षेत्रफल, स्वरूप/प्रकार (शासकीय वन, शासकीय राजस्व, सेवा भूमि, निजी भूमि, आदि) वर्तमान उपयोग, आदि का विवरण,
1.5 क्षेत्र में प्रचलित कृषि, व्यवसायिक तथा अन्य आर्थिक गतिविधियों का विवरण,
1.6 परियोजना के लिए अधिग्रहित की जाने वाली निजी भूमि के भूमि स्वामियों एवं पट्टेदारों का विवरण,
1.7 परियोजना के क्रियान्वयन से पर्यावरण पर पड़ने वाले संभावित प्रभावों (जैविक विविधता, वन, पानी तथा वायु पर संभावित प्रभावों) और पर्यावरण संरक्षण के लिये की जाने वाली कार्रवाई/उपायों का विवरण,
1.8 परियोजना के लिए भू-अर्जन के कारण विस्थापित परिवारों को आदर्श पुनर्वास नीति के प्रावधानों के अनुसार रोजगार उपलब्ध कराने के लिए कार्य योजना,
1.9 परियोजना के लिए भू-अर्जन के कारण रोजगार के लिए पात्र व्यक्तियों का कौशल बढाने, प्रशिक्षण देने संबंधी कार्ययोजना,
1.10 परियोजना का क्रियान्वयन करने वाले विभाग/उपक्रम/संस्थान द्वारा परियोजना के क्षेत्र में किए जाने वाले सामाजिक तथा कल्याणकारी कार्यकलापों का विवरण।
2. ऐसी पुनर्वास योजनाएं जिनमें भू-अधिग्रहण के फलस्वरूप पुनर्बसाहट आवश्यक हो:-
इन परियोजनाओं के लिए उपर्युक्त सामान्य प्रावधानों के साथ-साथ निम्नलिखित अतिरिक्त विवरण दिया जाएगा :-
2.1 विस्थापितों की अनिवार्यता के बारे में स्पष्ट वक्तव्य,
2.2 विस्थापित होने वाले प्रभावित परिवारों का विवरण।
2.3 विस्थापितों की पुनर्बसाहट के लिए पुनर्वास नीति के अनुरूप कार्य योजना जिसमें निम्नलिखित के उल्लेख हो :-
(क) पुनर्बसाहट हेतु भूमि चयन,
(ख) पुनर्बसाहट किये जाने वाले व्यक्तियों को भू-खण्ड आबंटन के प्रस्ताव,
(ग) पुनर्वासित किये जाने वाले व्यक्तियो के लिए वैकल्पिक रोजगार व्यवस्था का विवरण,
2.4 ऐसे व्यक्तियों जिनके बारे में फिर से विस्थापन की संभावना हो, यदि कोई हो तो के मामले में फिर से विस्थापन की अनिवार्यता के बारे में स्पष्ट वक्तव्य और उसके लिए प्रस्तावित काय्रक्रम।
3. कतिपय योजनाओं के लिए अतिरिक्त प्रावधान:-
सिंचाई पन बिजली परियोजनाओं, औद्योगिक/खनिज उत्पादन परियोजनाओं, अभयारण्य/राष्ट्रीय उद्यान परियोजनाओं आदि के मामलों में पुनर्वास योजना में उपर्युक्त पैरा-1 व 2 के अतिरिक्त इस नीति के खण्ड -11 के प्रावधानों के अनुसार अतिरिक्त सुस्पष्ट विवरण अंकित किये जाएंगे।

अतएव यह सहमति (मैमोरेन्डम ऑफ अन्डरस्टैंडिंग) आज दिनांक............ माह. .............वर्ष.......................को छत्तीसगढ़ राज्य की ओर से कलेक्टर जिला ..................(प्रथम पक्ष), जिस अभिव्यक्ति में जहां अपेक्षित हो, उनके पदानुवर्ती शामिल होंगे, और .................. विभाग/उपक्रम/ संस्थान (द्वितीय पक्ष), जिस अभिव्यक्ति में, जहां संदर्भ में अपेक्षित हो उनके वैद्य प्रतिनिधि, निष्पादक, उत्तराधिकारी शमिल होंगे, के बीच निम्नलिखित के संबंध में हुई सहमति को अभिलिखित करनें के लिए निष्पादित किया जाता हैः

3. प्रथम पक्ष जिला कलेक्टर द्वारा अनुषंगी कानूनों का पालन करते हुए भू-अर्जन अधिनियम 1894 तथा संबंधित नियमों व राज्य शासन के स्थायी निर्देशों का पालन करते हुए द्वितीय पक्ष की परियोजना के लिए आवश्यक निजी भूमि का अर्जन किया जाएगा। प्रथम पक्ष द्वारा अर्जित की गई निजी भूमि तथा शासकीय भूमि उद्योग विभाग /छत्तीसगढ़ स्टेट इन्डस्ट्रियल डेवलपमेंट कार्पोरेशन (सी.एस.आई.डी.सी.) के माध्यम से परियोजना के क्रियान्वयन हेतु ......................(विभाग/उपक्रम/संसथान) को उपलब्ध करायी जाएगी।
4. यदि किसी बिन्दु या विषय की व्यख्या संबंधी विवाद की स्थिति निर्मित होती है तो उसे निराकरण हेतु संबंधित जिला स्तरीय पुनर्वास समिति को संदर्भित किया जाएगा। विवादित बिन्दु का जिला स्तरीय पुनर्वास समिति के स्तर पर निराकरण न हो पाने की स्थिति में उसे राज्य शासन को संदर्भित किया जाएगा। राज्य शासन का निर्णय अन्तिम व बंधनकारी होगा।
